AN06-005
BACKGROUND:      This ordinance is submitted to present to Council the transcript of proceedings and papers relating to Annexation AN06-005 a certain petition for annexation as described in the ordinance which is attached hereto. More than sixty days have elapsed since August 16, 2006, the date of receipt from the Board of County Commissioners of Franklin County.
 
These are submitted in accordance with the Ohio Revised Code.
 
FISCAL IMPACT:      Provision of municipal services for a proposed annexation area has no fiscal impact.  However, provision of the stated services does represent cost to the city.  The annexation of land also has the potential to create revenue to the city.
 
Title
 
To accept the application (AN06-005) of Dominic Rotolo, et al. for the annexation of certain territory containing 6.1 ± Acres in Perry Township.
 
Body
 
WHEREAS,   a petition for the annexation of certain territory in Perry Township was duly filed by Dominic Rotolo, et al. on April 19, 2006; and
 
WHEREAS,  the said petition was duly considered by the Board of County Commissioners of  Franklin County, Ohio, and the annexation of said hereinafter described territory to the city of Columbus was approved by said Commissioners by order dated May 23, 2006; and
WHEREAS,  the Board of County Commissioners of  Franklin County certified the transcript of the proceedings in connection with the said annexation with the map and petition required in connection therewith to the City Clerk who received the same on August 16, 2006; and
WHEREAS,  sixty days from the date of said filing have now elapsed in accordance with the provisions of the Ohio Revised Code; and
 
WHEREAS,  it is in the best interest of the city of Columbus to accept the annexation of the territory sought to be annexed by the aforesaid petition; now, therefore,  
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
 
Section 1.  That the proposed annexation as applied for in the petition of Dominic Rotolo, et al. being the majority of owner(s) of real estate in the territory sought to be annexed and filed with the Board of County Commissioners of Franklin County, Ohio April 19, 2006 in which said petition prayed for annexation to the city of Columbus, Ohio, of certain territory adjacent thereto as hereinafter described, and which said petition was approved for annexation to the city of Columbus by the Board of County Commissioners by order dated May 23, 2006, be and the same is hereby accepted and said territory is hereby annexed to the city of Columbus.  Said territory is described as follows:
 
    Situate in the State of Ohio, County of Franklin, and Township of Perry, being a part of part of Section 1, Township 2, Range 19, United States Military Lands, and being all of a 2.15 acre tract conveyed to Dominic Rotola and Robin A. Rotola, of record in Instrument 200507140138701, being all of a 1 acre tract as conveyed to Dominic Rotola and Robin A. Rotola, of record in Instrument 200511090237545, being all of a 0.811 acre tract and a 1 acre tract as conveyed to Dominic Rotola, of record in Official Record 25461 D-04 and 25461 D-07,  and a portion of West Case Road (currently held as perpetual easement), all of the above aforementioned references to the Recorder's Office, Franklin County, Ohio, and bounded and describes as follows:
 
    Beginning at the southwest corner of the existing City of Columbus Corporation line as established by Ordinance No. 2050-96, and recorded in Official Record 33320 E-04, also being the intersection of the northerly right of way line of West Case Road and the westerly line of a 0.665 acre tract conveyed to Richard & Elizabeth Chapman;                                                                                                         
 
     thence, in a easterly direction, a distance of approximately 99 feet,  along the northerly right of way line of West Case Road, also being along said existing City of Columbus Corporation line, to the easterly line of said 0.665 acre tract, also being the westerly line of said 0.826 acre tract;
 
    thence, in a northerly direction, a distance of approximately 5 feet, along the westerly line of said 0.826 acre tract, along the easterly line of said 0.665 acre tract, also along the westerly line of a 0.083 acre tract as conveyed to the County of Franklin as a highway easement, and also along the said existing City of Columbus Corporation line, to an angle point in the northerly right of way line of said West Case Road;
 
    thence, in a easterly direction, a distance of approximately 120 feet, leaving said existing City of Columbus Corporation line, along the northerly right of way line of said West Case Road, along the northerly line of said 0.083 acre tract of land, to the easterly line of said 0.826 acre and 0.083 acre tracts of land, and the westerly line of a 0.5 acre tract as conveyed to Greg A. Bourdo & Brie A. Shaffer;
 
    thence, in a southerly direction, a distance of approximately 5 feet, along the easterly line of said 0.083 acre and 0.826 acre tracts of  land, also along the westerly line of said 0.5 acre tract, to the northerly right of way line of said West Case Road;
 
    thence, in an easterly direction, a distance of approximately 379 feet, along said northerly right of way line of West Case Road, also partially along said existing City of Columbus Corporation line, to an angle point in the northerly right of way line of West Case Road, being the westerly line of a 0.095 acre tract of land conveyed to the County of Franklin as a highway easement, also being the westerly line of a 0.99 acre tract of land as conveyed to Jo Ellen Griffith;
 
    thence, in a northerly direction, a distance of approximately 5 feet, along the westerly line of said 0.99 acre tract of land, also along the easterly line of a 8.567 acre tract of land conveyed to Michael D. Steffensmeier and Janet M. Steffensmeier, also along the westerly line of said 0.095 acre tract, also along the northerly right of way line of said West Case Road, and also along said existing City of Columbus Corporation line, to an angle point in the northerly right of way line of West Case Road;
 
    thence, in a easterly direction, a distance of approximately 134 feet, leaving said existing City of Columbus Corporation line, along said northerly right of way line of West Case Road, also along the northerly line of said 0.095 acre tract, to an angle point in the northerly right of way of West Case Road, to the easterly line of said 0.99 acre tract, also being the westerly line of a 1.864 acre tract as conveyed to Norma Bowen;
 
     thence, in a southerly direction, a distance of approximately 5 feet, along said northerly right of way line of West Case Road, also along the easterly line of said 0.99 acre tract, also along said existing City of Columbus Corporation line as established by Ordinance No. 1012-85, and recorded in Official Record 06115 C-19, to a point in said northerly right of way line of West Case Road;
 
    thence, in a easterly direction, a distance of approximately 591 feet, partially along said northerly right of way line of West Case Road, along said existing City of Columbus Corporation line to the northeasterly corner of said existing City of Columbus corporation line, to the existing City of Columbus Corporation line as established by Ordinance No. 1030-66, and Recorded in Misc. Record 141 page 248;
 
    thence, in a southerly direction, a distance 355 feet, along the easterly line of said 2.15 acre tract, along a westerly line of  the Gables West Subdivision as recorded in Plat Book 43 Page 78, along said existing City of Columbus Corporation line, to the southeast corner of said 2.15 acre tract;
 
    thence, in a westerly direction, a distance of approximately 657 feet, along the southerly lines of said Rotola tracts, along a northerly line of said Gables West Subdivision, and also along said existing City of Columbus Corporation line, to the westerly line of said 0.811 acre tract;
 
     thence, in a northerly direction, a distance of approximately 305 feet, leaving said existing City of Columbus Corporation line, along the westerly line of said 0.811 acre tract, along the easterly line of a 1.189 acre tract as conveyed to Donald W. Piteo, TR and Donna M. Piteo, TR, to the southerly right of way line of said West Case Road,;
 
     thence, in a westerly direction, a distance of approximately 672 feet, along the southerly right of way line of said West Case Road, to the extension of said existing City of Columbus Corporation line (Ordinance 2050-96) extended southerly to the intersection of the southerly line of said West Case Road;
 
    thence, in a northerly direction, a distance of approximately 50 feet, along said extension of said (Ordinance 2050-96), to the TRUE PLACE OF BEGINNING, containing approximately 6.1 acres of land more or less.
 
Section 2.  That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.
 
Section 3.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
