Explanation

1.  Background

The Polaris Carwash LLC, by Jordon Yates, Member of Polaris Car Wash LLC, and Polaris 91 LLC and Polaris Neighborhood Center IV, LLC, by Franz Geiger, Vice President, owners of the platted land, have submitted the plat titled “Dedication Plat of Ceres Drive Extension and Easements” to the City Engineer’s Office for review and approval.  This plat has been reviewed and approved by the City Engineer.  The following ordinance allows the City to accept said plat for property located for the extension of Ceres Drive to support new development in the area.

 

2.  Fiscal Impact

There is no fiscal impact to the City to accept the plat.

 

3.  Emergency Justification

Emergency action is requested to complete the required transfer so that the construction project may be begin as soon as possible, allowing the construction to start in early 2024 and be completed within the same construction season to support new development in the area and to ensure the safety of the traveling public.

To accept the plat titled “Dedication Plat of Ceres Drive Extension and Easements” from Polaris Carwash LLC, Polaris 91 LLC and Polaris Neighborhood Center IV, LLC; and to declare an emergency.  ($0.00)

 

Body

WHEREAS, the plat titled “Dedication Plat of Ceres Drive Extension and Easements” (hereinafter “plat”) has been submitted to the City Engineer’s Office for approval and acceptance; and

 

WHEREAS, Polaris Carwash LLC, by Jordon Yates, Member of Polaris Car Wash LLC, and Polaris 91 LLC and Polaris Neighborhood Center IV, LLC, by Franz Geiger, Vice President, owner of the platted land, desires to dedicate to the public use all or such parts of the avenues and easements shown on said plat and not heretofore so dedicated; and

 

WHEREAS, after examination, it has been found to be in the best interest of the City to accept said plat; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to authorize acceptance of the referenced plat to allow new development in the area of Ceres Drive to proceed as quickly as possible to allow construction to begin in early 2024 so that it can be completed within the same construction season to support new development in the area and to ensure the safety of the traveling public, all for the immediate preservation of the public health, peach, property, safety and welfare; and now therefore,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS

 

SECTION 1.  That the plat titled “Dedication Plat of Ceres Drive Extension and Easements” on file in the office of the City Engineer, Division of Design and Construction, be and the same is hereby accepted.

 

SECTION 2.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
