BACKGROUND:  This legislation authorizes the Director of Public Utilities to enter into a Guaranteed Maximum Reimbursement agreement with Blue Heron Land Co. for the construction, inspection, and staking of a water main on South Fifth Street, between Town Street and Rich Street.  The City of Columbus agreed to pay a guaranteed maximum reimbursement of $228,000.  The City originally planned to construct this project in the future.  The developer recently purchased ground and needs the water main sooner than the City was planning to design, procure, and construct.  The developer has agreed to construct the line at their cost and then obtain reimbursement from the City due to the more immediate need.
 
Emergency action is requested as the construction of the water main cannot happen until the City has entered into an executed agreement with Blue Heron Land Co.  Any delay in this process will cause a delay for potential property owners in obtaining occupancy.

WHEREAS, the Director of Public Utilities needs to enter into a Guaranteed Maximum Reimbursement agreement with Blue Heron Land Co. for the construction, inspection, and staking of a water main on South Fifth; and
 
WHEREAS, the Department of Public Utilities will pay a guaranteed maximum reimbursement of $228,000; and
 
WHEREAS, it is necessary to authorize an amendment to the 2007 Capital Improvements Budget for purposes of providing sufficient funding and spending authority for the aforementioned project expenditures; and
 
WHEREAS, it is necessary for this Council to authorize the City Auditor to transfer funds within the Water Works Enlargement Voted 1991 Bonds Fund; and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Power and Water, Department of Public Utilities, in that it is immediately necessary to authorize the Director of Public Utilities to enter into a Guaranteed Maximum Reimbursement agreement with Blue Heron Land Co. for the construction, inspection, and staking of a water main on South Fifth Street, for the Division of Power and Water, in an emergency manner as the construction of the water main cannot happen until the City has entered into an executed agreement with Blue Heron Land Co.  Any delay in this process will cause a delay for potential property owners in obtaining occupancy, for the immediate preservation of public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Public Utilities is authorized to enter into a Guaranteed Maximum Reimbursement agreement with Blue Heron Land Co. pursuant to Section 186 of the Columbus City Charter for the construction, inspection, and staking of a water main on South Fifth Street, for the Division of Power and Water.
 
SECTION 2.  That the City Auditor is hereby authorized and directed to transfer $228,000 within the Division of Power and Water (Water), Dept/Div. No. 60-09, Water Works Enlargement Voted 1991 Bonds Fund, Fund No. 606, Object Level One 06, Object Level Three 6629, as follows:

SECTION 3.  That the 2007 Capital Improvements Budget is hereby amended as follows:

SECTION 4.  That for paying the cost of this water line improvement, the Guaranteed Maximum Reimbursement up to and including $228,000.00 is hereby authorized from the Water Works Enlargement Voted 1991 Bonds Fund No. 606, Department 60, Division 09, OCA Code 642900, Object Level One 06, Object Level Three 6629, Project Number 690290, to pay the cost thereof.
 
SECTION 5.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
SECTION 6.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
SECTION 7.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.
 
SECTION 8.  That for reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
