Explanation

 

1. BACKGROUND: This legislation authorizes the Director of Public Utilities to modify (Mod #1) an existing engineering agreement with Evans, Mechwart, Hambleton and Tilton, Inc. in the amount of $230,000 for the Stormwater Strategic Plan, Phase 2, CIP 611032-100000. The work to be performed under this contract will improve the efficiency of the identification, design, and construction of stormwater infrastructure, which in turn can be expected to reduce construction and long-term maintenance costs.

 

Modification Information:

1.1 Amount of additional funds to be expended: $230,000.00

Original Contract Amount (PO066395): $310,000.00

Modification #1 (Current): $230,000.00

TOTAL CONTRACT AMOUNT INCLUDING THIS MODIFICATION...........  $540,000.00

Maximum monetary obligation of the City under this contract as amended shall not exceed $540,000.00

1.2 Reasons additional goods/services could not be foreseen.

Additional stormwater engineering work has been identified that was not known at the time the original engineering agreement was legislated, but is critical to the sewer system infrastructure.

1.3 Reason other procurement processes are not used:

Additional stormwater work has been identified that is part of this planned work.

1.4 How cost of modification was determined:

An engineering cost estimate was negotiated with the firm.

3. EMERGENCY DESIGNATION: Emergency designation is not requested at this time.

 

4. ECONOMIC IMPACT: The work to be performed under this contract will improve the efficiency of the identification, design, and construction of stormwater infrastructure which in turn can be expected to reduce construction and long-term maintenance costs.

5. FISCAL IMPACT: This ordinance authorizes a transfer and expenditure up to $230,000.00 from the Storm Sewer Bonds Fund 6204. An amendment to the 2019 Capital Improvements Budget is also necessary.

To authorize the Director of Public Utilities to modify and increase an existing engineering agreement with Evans, Mechwart, Hambleton and Tilton, Inc. for the Stormwater Strategic Plan, Phase 2 Project; to authorize the transfer within and the expenditure of up to $230,000.00 from the Storm Sewer Bonds Fund; and to amend the 2019 Capital Improvements Budget. ($230,000.00)

 

Body

WHEREAS, Purchase Order No. 066395 was authorized by Ordinance Number: 1290-2017, passed June 5, 2017 and did authorize the Director of Public Utilities to enter into a contract for the Stormwater Strategic Plan, Phase 2 Project; and

WHEREAS, Purchase Order No. PO066395 was executed June 9, 2017, and approved by the City Attorney June 12, 2017; and

WHEREAS, it is necessary to modify Purchase Order No. PO066395 to provide for additional services in regards to the Stormwater Strategic Plan, Phase 2 Project; and

WHEREAS, it is necessary to modify the original contract in order to provide additional funding for this project because of scope changes; and

 

WHEREAS, it is necessary to amend the 2019 Capital Improvement Budget; and

 

WHEREAS, it is necessary to authorize the transfer within and expenditure of up to $230,000.00 from the Storm Sewer Bonds Fund 6204; and

 

WHEREAS, it has become necessary in the usual daily operation of the Division of Sewerage & Drainage, Stormwater Section, Department of Public Utilities, to authorize the Director of Public Utilities to modify a professional engineering services agreement with Evans, Mechwart, Hambleton and Tilton for the Stormwater Strategic Plan, Phase 2 Project; for the preservation of the public health, peace, property and safety; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That the Director of Public Utilities is hereby authorized to modify and increase an existing engineering agreement with Evans, Mechwart, Hambleton and Tilton, Inc. 5500 New Albany Road, Columbus, Ohio 43054, for the Stormwater Strategic Plan, Phase 2, CIP 611032-100000, in accordance with the terms and conditions of the contract on file with the Division of Sewerage and Drainage.

 

SECTION 2. That the City Auditor is hereby authorized to transfer $230,000.00 within the Storm Sewer Bonds Fund 6204, per the account codes in the attachment to this ordinance.

 

SECTION 3: That the 2019 Capital Improvements Budget is hereby amended as follows:

SECTION 4. That the Director is hereby authorized to expend up to $230,000.00 or as much thereof as may be needed from the Storm Sewer Bonds Fund 6204, per the account codes in the attachment to this ordinance.

 

SECTION 5. That the funds necessary to carry out the purpose of this Ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 6. That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.

 

SECTION 7. That the City Auditor is authorized to establish proper project accounting numbers as appropriate.

 

SECTION 8. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.

 

SECTION 9. That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
