Explanation
The Transportation Division is responsible for routine and emergency street repairs and maintenance throughout the year. The Division uses asphalt emulsion in its surface treatment program to effect repairs and maintenance to streets, gravel alleys and berms. It is also used in its Rosco patching machines to patch potholes on city streets.
The Purchasing Office has established a citywide universal term contract no. FL003624 with Phillips Oil Company of Central Ohio, Incorporated, contract compliance #208200717 (Expiring 2/27/10), for the purchase of asphalt emulsion. This legislation will authorize the expenditure of $62,000.00 for asphalt emulsion using the universal term contract.
Emergency action is requested to allow immediate expenditure of the necessary funds for the purchase of this material due to the high amount of these repairs that have occurred already this year.
FISCAL IMPACT: Funds in the amount of $62,000.00 are budgeted and available in the Municipal Motor Vehicle License Tax Fund for this purpose. The Division expended $105,517.98, $144,826.11 and $98,000.00 for asphalt emulsion in 2006, 2007 and 2008, respectively.

To authorize the Finance and Management Director to issue a blanket purchase order for the purchase of asphalt emulsion to Phillips Oil Company of Central Ohio, Incorporated, in accordance with the terms and conditions of the applicable citywide universal term contract; to authorize the expenditure of $62,000.00 from the Municipal Motor Vehicle License Tax Fund for the Transportation Division; and to declare an emergency. WHEREAS, the daily activities of the Transportation Division require the purchase and use of asphalt emulsion to effect repairs and maintenance to streets, gravel alleys and berms and to patch potholes on city streets; and
WHEREAS, funds are budgeted and available in the Municipal Motor Vehicle License Tax Fund for the purchase of asphalt emulsion; and
WHEREAS, an emergency exists in the usual daily operation of the Transportation Division in that this purchase order should commence immediately so that the work my proceed without delay, thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Finance and Management Director be and is hereby authorized to issue a blanket purchase order to Phillips Oil Company of Central Ohio, Incorporated, for the procurement of asphalt emulsion in an amount not to exceed $62,000.00 for the Transportation Division in accordance with the specifications of the citywide universal term contract.
SECTION 2. That the expenditure of $62,000.00 or so much thereof as may be needed be and hereby is authorized from Fund 266, the Municipal Motor Vehicle License Tax Fund, Department 59-09, Transportation Division, Object Level One Code 02, Object Level Three Code 2262, and OCA Code 599115 ($62,000.00) for the purchase of asphalt emulsion.
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
