Council Variance Application: CV24-124

 

APPLICANT: NRP Holdings, LLC, c/o Dave Perry, Agent; David Perry Company, Inc.; 411 East Town Street, First Floor; Columbus, OH 43215, and Donald Plank, Atty.; 411 East Town Street, Second Floor; Columbus, OH 43215.

 

PROPOSED USE: Multi-unit residential development.

                                                                                 

CITY DEPARTMENTS' RECOMMENDATION: Approval. The applicant has received a recommendation of approval from Staff and the Development Commission for a concurrent rezoning to the L-AR-1 and L-AR-12, Limited Apartment Residential districts (Ordinance #0276-2026; Z24-052) for a multi-unit residential development totaling 474 units; 336 units in the L-AR-1 (Area East) portion of the site, and 138 dwelling units in the L-AR-12 (Area West) portion of the site. This t Council variance request includes variances to building height, -----------------------building lines, perimeter yards, and private streets. The proposed multi-unit residential development at this site will encompass two future parcels, Area East and Area West. Those future parcels are referenced in the variances below. The proposal is consistent with The Northwest Plan’s (2016) recommendation that parking lots should be placed behind, or if necessary, next to buildings. Staff are supportive of proposed elevations for the multi-unit and townhouse buildings, as they are consistent with Plan’s design guidelines.

To grant a Variance from the provisions of Sections 3309.14(A), Height districts; 3333.18, Building lines; 3333.255, Perimeter yard; and 3333.41(H), Standards, of the Columbus City codes; for the property located at 2575 W. DUBLIN-GRANVILLE RD. (43235), to allow reduced development standards for  multi-unit residential developments in the L-AR-1, Limited Apartment Residential District and L-AR-12, Limited Apartment Residential District (Council Variance #CV24-124).

 

Body

 

WHEREAS, by application #CV24-124, the owner of property at 2575 W. DUBLIN-GRANVILLE RD. (43235), is requesting a Variance to allow reduced development standards for multi-unit residential developments in the L-AR-1, Limited Apartment Residential District and L-AR-12, Limited Apartment Residential District; and

 

WHEREAS, Section 3309.14(A), Height districts, prohibits the height of a building to exceed 35 feet at the building setback line, while the applicant proposes an increased building height of 37 feet for the proposed townhouse development for Area West; and

 

WHEREAS, Section 3333.18, Building lines, requires a building line of 60 feet for all structures, while the applicant proposes to allow utility enclosures, A/C equipment, and hotboxes/water vaults within the building setback line of Area West along West Dublin-Granville Road; and 

 

WHEREAS, Section 3333.255, Perimeter yard, requires a minimum perimeter yard width of 25 feet, while the applicant proposes a minimum perimeter yard width of 15 feet for the west perimeter yard of Area East and a minimum perimeter yard width of 15 feet for the east, west and south perimeter yards of Area West; and

 

WHEREAS, Section 3333.41(h), Standards, requires that each lot in a townhouse development front on a dedicated public street, while the applicant proposes all lots front upon private streets for Area West; and

 

WHEREAS, City Departments recommend approval because the requested variances are necessary to facilitate the proposed plans included with Ordinance #0276-2026; (Z24-052) which meet design guidelines included in the Northwest Plan; and 

 

WHEREAS, said ordinance requires separate submission for all applicable permits and Certificates of Occupancy for the proposed multi-unit residential developments; and

 

WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and

 

WHEREAS, the granting of said variance will not impair an adequate supply of light and air to adjacent properties or unreasonably increase the congestion of public streets, or unreasonably diminish or impair established property values within the surrounding area, or otherwise impair the public health, safety, comfort, morals, or welfare of the inhabitants of the City of Columbus; and

  

WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owners of the property located at 2575 W. DUBLIN-GRANVILLE RD. (43235), in using said property as desired and; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That a variance be granted from the provisions of Sections 3309.14(A), Height districts; 3333.18, Building lines; 3333.255, Perimeter yard; and 3333.41(H), Standards, of the Columbus City codes; for the property located at 2575 W. DUBLIN-GRANVILLE RD. (43235), insofar as said sections prohibit multi-unit residential development with an increased building height of 37 feet; utility enclosures, A/C equipment, or hotboxes/water vaults being located within a required building setback line in Area West; reduced perimeter yard from 25 feet to 15 feet for Area East and Area West; and lots in a townhouse development fronting on private streets; said property being more particularly described as follows:

 

2575 W. DUBLIN-GRANVILLE RD. (43235), being 27.27± acres located on the south side of West Dublin-Granville Road, at the terminus of McVey Boulevard, and being more particularly described as follows:

 

AREA EAST, 13.97± acres: 

 

Situated in the State of Ohio, County of Franklin, Township of Perry, City of Columbus, Section 4, Township 2, Range 19, United States Military Lands, and being 13.97+/- acres out of an original 102 acre tract of land as conveyed to State of Ohio, of record in Deed Book 1957, Page 195, all document references are to the records of the Recorder’s Office of Franklin County, Ohio, and being more particularly described as follows:

 

BEGINNING at the southwesterly corner of a 7.981 acre tract of land as conveyed to Tansky Properties, LLC, of record in Instrument Number 200407120161022;

 

Thence through said 102 acre tract the following courses:

 

North 88°11’50” West, a distance of 440.01 feet to a point;

 

North 1°29’19” East, a distance of 435.55 feet to a point;

 

North 87°46’43” West, a distance of 195.00 feet to a point;

 

North 1°29’19” East, a distance of 740.06 feet to a point in the centerline of West Granville Road

SECTION 2.  That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for multi-unit residential development, or those uses permitted in the L-AR-1, Limited Apartment Residential District  and L-AR-12, Limited Apartment Residential District, specified by Ordinance #0276-2026; Z24-052.

 

SECTION 3.  That this ordinance is further conditioned on the applicant obtaining all applicable permits and Certificates of Occupancy for the proposed multi-unit residential developments.

 

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
