Explanation
1. BACKGROUND.
This legislation authorizes the Director of Public Utilities to execute a professional engineering services contract modification with DLZ Ohio, Inc., for additional construction design services that were performed for the Beulah Road Trunk Sewer Rehabilitation Project which is located in the Glen Echo Ravine of the Clintonville community. The limits of this project will be the Olentangy River to the west, and Interstate 71 to the east.
This contract modification will provide for the payment of additional services that were requested by the Division of Sewerage and Drainage to incorporate the rehabilitation of approximately 6,000 LF of 30" sanitary sewer. This particular sewer is in Glen Echo Ravine, an environmentally sensitive area. Plans and specifications will be completed in 2007 after further input from residents and community groups. Pending land acquisition, the project will be bid for construction in 2008.
2. FISCAL IMPACT.
Although there is sufficient budget authority already available, this legislation includes a necessary cash transfer within the Voted Sanitary Sewer Bond Fund to provide sufficient funding for the project.

WHEREAS, Ordinance No. 2327-2003, as passed November 24, 2003, authorized the Director of Public Utilities to enter into a professional engineering services contract with DLZ Ohio, Inc., for the preparation of construction plans and specifications for the Beulah Road Trunk Sewer Rehabilitation Project which is located in the Glen Echo Ravine of the Clintonville community; and
WHEREAS, concerns were raised by residents and community groups at an initial public meeting and have been determined to require modification of the scope of services contained in the contract; and
WHEREAS, these changes in scope can be addressed by subcontracting with FMSM, a stream restoration expert; and
WHEREAS, the Division of Sewerage and Drainage has requested plan revisions for stream restoration to satisfy community concerns and be environmentally friendly in the sensitive ravine; and
WHEREAS, the Division of Sewerage and Drainage engineering personnel have determined it to be in the best interest of the City of Columbus to incorporate this additional design work into its contract with DLZ Ohio, Inc.; and
WHEREAS, it is necessary to transfer money within the Voted Sanitary Sewer Bond Fund for the Beulah Road Trunk Sewer Rehabilitation Project; and
WHEREAS, it is therefore necessary for the Division of Sewerage and Drainage, Department of Public Utilities, to request this City Council to authorize the Director of Public Utilities to modify the subject contract for purposes of increasing the existing scope of services, to allow for the increased cost of said services, and authorize the necessary expenditure at the earliest practicable date, now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of Public Utilities be, and hereby is, authorized to modify Contract No. EL004058 with DLZ Ohio, Inc., 6121 Huntley Road, Columbus, Ohio 43229, in order to provide for the payment of additional design services required to successfully complete the aforementioned sanitary sewer improvement projects in the Clintonville community, in accordance with the terms and conditions as shown in the contract modification on file in the office of the Division of Sewerage and Drainage.
Section 2. That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
Section 3. That the City Auditor be and hereby is authorized and directed to transfer cash of $60,651.70 within the Voted Sanitary Sewer Bond Fund No. 664, Dept. 60-05, Object Level Three 6676, as follows:

Section 4. That for the purpose of paying the cost of the aforementioned professional engineering contract modification, the expenditure of $60,651.70, is hereby is authorized within Division 60-05, Fund 664, Object Level-1 06, OCA 664625, Object Level-3 6676, for Project 650625, Beulah Road Trunk Sewer Rehabilitation.
Section 5. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
Section 6. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
