Explanation
BACKGROUND: The City owns real property located at 1860 Sullivant Avenue, Columbus, Ohio 43223, {Franklin County Tax Parcel 010-308998} (“Property”) that is the site of a future police substation, currently under construction. The property is managed by the Department of Development (“Development”). It is further described and recorded in Instrument Number 202212090166179 Recorder’s Office, Franklin County, Ohio. In order to support the construction of the new police substation, there is a need for the Ohio Power Company, doing business as American Electric Power, (“AEP”) to install electric lines and facilities to provide electric service to the Property. AEP now requests the applicable 0.036 acre electric utility easement to burden a portion of the Property in order to maintain certain electric facilities and associated appurtenances for the service of electrical energy and impulses to the Property. The Department of Development reviewed the request and supports granting AEP an easement at no cost in consideration that (i) the Easement supports only electricity services to the Property, and (ii), the Easement will be nonexclusive. Additionally, AEP has an existing electrical distribution line running through the parcel for which no easement has been found. The Department of Development reviewed a request by AEP to grant a 0.086 acre easement for this line and supports granting AEP an easement at no cost in consideration that (i) the Easement supports long established electric distribution lines serving nearby property, including the new police substation, and (ii), the Easement will be nonexclusive. The 0.036 acre service easement and 0.086 acre electric utility easement known collectively as (“Easement”).

EMERGENCY JUSTIFICATION: Emergency action is requested in order to provide permanent power to the new police substation by the end of October. Meeting the October date will avoid additional project costs and an extended project completion date, which will preserve the public peace, health, property, safety, and welfare.

WHEREAS, the City owns property at 1860 Sullivant Avenue, Columbus, Ohio 43223, {Franklin County Tax Parcel 010-308998} (“Property”); and
WHEREAS, the City intends to grant The Ohio Power Company, an Ohio corporation doing business as American Electric Power, (“AEP”) two electric utility easements burdening a portion of the Property in order to maintain certain electric facilities and associated appurtenances for the delivery electrical energy and impulses (“Easement”) for the benefit of the Property and surrounding properties; and
WHEREAS, the City intends to quitclaim grant AEP the Easement in consideration (i) the Easement supports electricity services to the Property and surrounding properties, and (ii) the Easement will be nonexclusive; and
WHEREAS, the City intends for the Director of the Department of Development, or their designee, to execute and acknowledge any document(s) necessary to quitclaim grant the Easement to AEP; and
WHEREAS, the City intends for the Department of Law, Real Estate Division to approve all document(s) associated with this ordinance; and
WHEREAS, an emergency exists in the usual daily operations of Development in that it is immediately necessary to grant the Easement in order to provide permanent power to the new police substation by the end of October and prevent unnecessary delay in completing the construction project, which will preserve the public peace, property, health, welfare, and safety; and now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
SECTION 1. That the Director of the Department of Development, or their designee, be, and hereby is, authorized to execute and acknowledge any document(s) necessary to quitclaim grant to the Ohio Power Company, an Ohio corporation doing business as American Electric Power, (“AEP”) and its successors and assigns a 0.036 acre electric service utility easement and a 0.086 acre electric distribution utility easement burdening a portion of the City’s real property located at 1860 Sullivant Avenue, Columbus, Ohio 43223, {Franklin County Tax Parcel 010-308998} (“Property”), which is described and depicted in the four (4) page attachment which is fully incorporated for reference as if rewritten, in order for AEP to nonexclusively maintain certain electric facilities and associated appurtenances for the distribution and delivery of electrical energy and impulses for the benefit of the Property and surrounding properties.
SECTION 2. That the Department of Law, Real Estate Division is required to preapprove all document(s) executed by the City pursuant to this ordinance.
SECTION 3. That this ordinance, for the reasons stated in the preamble, which are made a part of this ordinance and fully incorporated for reference as if rewritten, is declared to be an emergency measure and shall take effect and be in force from and after this ordinance’s adoption and approval by the Mayor or ten (10) days after its adoption if the Mayor neither approves nor vetoes this ordinance.
