Title: To authorize the Director of the Department of Public Utilities to execute those instruments necessary to release certain sewer easements, located in the vicinity of Postlewaite Road, at the request of Gregory A. Marietti, in exchange for a replacement easement previously granted to the City of Columbus, Ohio.
Explanation
 
Background:    The City of Columbus, Ohio is the holder of certain sanitary sewer easement rights, located in the vicinity of Postlewaite Road by virtue of a recorded deed of easement.  The subject real property is more fully described within the body of this legislation.  Gregory A. Marietti, the owner, has requested the City release certain portions of the aforementioned sewer easement in exchange for a previously granted replacement easement.  After investigation, the Department of Public Utilities has determined that the release of the aforementioned easement will not adversely affect the City and therefore should be granted.  The following legislation authorizes the Director of the Department of Public Utilities to execute those instruments necessary to release the subject sewer easement.Fiscal Impact:     N/AEmergency Justification:    N/A
 
Title
 
To authorize the Director of the Department of Public Utilities to execute those instruments necessary to release certain sewer easements, located in the vicinity of Postlewaite Road, at the request of Gregory A. Marietti, in exchange for a replacement easement previously granted to the City of Columbus, Ohio.
 
 
Body
 
WHEREAS,      the City of Columbus, Department of Public Utilities, is the owner of a certain sanitary sewer easement by virtue of a recorded deed of easement in the Franklin County Recorders Office; and
 
WHEREAS,      Gregory A. Marietti, the subject real property owner, has requested that a certain portion of the aforementioned sewer easement be released in exchange for a replacement easement previously granted to the City of Columbus; and
 
WHEREAS,      the Department of Public Utilities, Division of Sewerage & Drainage, after investigation, has determined that the release of the subject easement rights will not adversely affect the operations of the City of Columbus; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
      Section 1.      That the Director of the Department of Public Utilities be, and hereby is authorized to execute those documents, approved by the Department of Law, Real Estate Division, necessary to release certain sanitary easement rights in and to the following described real property:
0.154 ACRE +
      Situated in the State of Ohio, County of Franklin, Township of Perry, Quarter Township 4, Township 2, Range 19, United States Military Lands and being part of Parcel One and Two as shown in the deed to Gregory A. Marietti of record in Instrument Number 200112280303012 and part of that 0.271 and 0.288 acre tracts as shown in the deed to Gregory A. Marietti of record in Instrument Number 200112030279925 (all references refer to the records of the Recorder's Office, Franklin County, Ohio) and described as follows:
      Beginning, for reference at the southwesterly corner of said Parcel Two, the northwesterly corner of that tract conveyed to Richard A. Leasure and Helen M. Leasure, Trustees of record in Instrument Number 200004110070018;
      Thence South 86º 40' 58" East, with the southerly line of said Parcel Two a distance of 10.52 feet to the True Point of Beginning;
      Thence North 21º24'56" East, across said Marietti tracts with the easterly right of way line of Postlewaite Road (Road Record 6, Page 30), a distance of 337.26 feet to the northerly line of said 0.271 acre tract;
      Thence South 79º 12' 59" East, with the northerly line of said 0.271 acre tract a distance of 20.35 feet;
      Thence South 21º24'59" West, across said Marietti tracts, a distance of 334.47 feet to the southerly line of said Parcel Two;
      Thence North 86º40'58" West, with the southerly line of said Parcel Two, a distance of 21.04 feet to the True Point of Beginning and containing 0.154 acre, more or less.
 
      Section 2.      That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
