Title: To authorize the Executive Director of the Recreation and Parks Department to execute those documents necessary to grant Columbia Gas of Ohio, Inc., gas line utility easements through certain real property owned by the City, and jointly owned with the Franklin County Commissioners, in order to relocate those gas lines which were displaced by the Ohio Department of Transportation's relocation of Powell Road south through Columbus Zoo property.
Explanation
 
Background: The City of Columbus ("City") is sole owner of real property leased for the Columbus Zoo located in the vicinity of State Route 750 (Powell Road), as well as joint owners with the Franklin County Commissioners ("County") of another parcel leased for the Zoo located in the same vicinity.  Columbia Gas of Ohio, Inc. has requested a gas line easements through these properties in order to relocate gas lines which were displaced by the Ohio Department of Transportation's relocation of Powell Road south through Columbus Zoo property.  The following legislation authorizes the Executive Director of the Recreation and Parks Department to execute those documents necessary to grant Columbia Gas of Ohio, Inc. gas line easements through those subject properties owned by the City and jointly owned with the Franklin County Commissioners, more fully described in the body of this legislation.  The Columbus Zoo has reviewed the proposed easements and has no objection to the location.

Title
 
To authorize the Executive Director of the Recreation and Parks Department to execute those documents necessary to grant Columbia Gas of Ohio, Inc., gas line utility easements through certain real property owned by the City, and jointly owned with the Franklin County Commissioners, in order to relocate those gas lines which were displaced by the Ohio Department of Transportation's relocation of Powell Road south through Columbus Zoo property.

WHEREAS,      the City of Columbus ("City") is sole owner of a parcel of real property leased to the Columbus Zoo through which the relocation of (Powell Road) is proposed, as well as joint owners with the Franklin County Commissioners ("County") of separate real property located in the same vicinity; and
 
WHEREAS,      Columbia Gas of Ohio, Inc. has requested gas line easements through the aforementioned real properties in order to relocate those gas lines which were displaced by the Ohio Department of Transportation's relocation of Powell Road south through Columbus Zoo property; and
 
WHEREAS,      the following legislation authorizes the Executive Director of the Recreation and Parks Department to execute those documents necessary to grant Columbia Gas of Ohio, Inc. gas line easements through those subject properties owned by the City and jointly owned with the Franklin County Commissioners, more fully described in the body of this legislation; now, therefore:
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
      Section 1.      That the Executive Director of the Recreation and Parks Department be and hereby is authorized to execute those documents, as approved by the Department of Law, Real Estate Division, necessary to grant a gas utility line easement in, over, under, across and through the following described real property:
 
GAS PIPELINES EASEMENTS
ON THE PROPERTY OF:
THE CITY OF COLUMBUS, OHIO
(COLUMBUS ZOO)
 
Situated in the State of Ohio, County of Delaware, Township of Liberty, Farm Lot 15, Section 3, Township 3, Range 9, United States Military Lands, being located in that 37.169 acre (original) tract of land as described in a deed to The City of Columbus, Ohio, of record in Deed Volume 441, Page 537, all records referenced herein being to the records of the Delaware County Recorder's Office, Delaware, Ohio, and being two 20 foot wide gas pipeline easements more particularly described as follows:
      EASEMENT STRIP No. 1
Beginning at a point in the northerly limited access right-of-way line of relocated State Route 750, at station 103+40.00, 110.00 feet left of centerline as indicated in the Right-of-way plan "DEL-750-0.03", circa 2006; thence through said 37.169 acre tract the following courses:
      
1.      North 45º48'10" East a distance of 20.00 feet to a point;
2.      South 44º11'50" East a distance of 136.09 feet to a point in a westerly line of that existing gas pipeline easement of record in Deed Volume 0581, Page 161;
3.      South 44º03'23" West along said westerly easement line, a distance of 20.01 feet to a point in the northerly limited access right-of-way line of said State Route 750;
Thence North 44º11'50" West along said northerly limited access right-of-way line, a distance of 136.70 feet to the place of beginning, containing 0.063 acre of land.
      Bearings herein are referenced to the Right-of-way plan "DEL-750-0.03", circa 2006.  This description was prepared by Westerville Land Surveying, LLC based on record survey information.
 
      Section 2.      That the Executive Director of the Recreation and Parks Department be and hereby is authorized to execute those documents, as approved by the Department of Law, Real Estate Division, necessary to grant a gas utility line easement in, over, under, across and through the following described real property:
 
 
GAS PIPELINES EASEMENT
ON THE PROPERTY OF:
THE CITY OF COLUMBUS, OHIO &
BOARD OF COMMISSIONERS OF FRANKLIN COUNTY
 
Situated in the State of Ohio, County of Delaware, Township of Liberty, Farm Lot 15, Section 3, Township 3, Range 9, United States Military Lands, being located in that 265.58 acre (original) tract of land as described in a deed to City of Columbus, Ohio and Board of Commissioners of Franklin County, of record in Deed Volume 514, Page 448, all records referenced herein being to the records of the Delaware County Recorder's Office, Delaware, Ohio, and being a 20 foot wide gas pipelines easement more particularly described as follows:
      Beginning at the point of intersection of the southerly limited access right-of-way line of relocated State Route 750 with the northerly line of said 265.58 acre tract, at station 103+77.96, 59.55 feet right of centerline as indicated in the Right-of-way plan "DEL-750-0.03", circa 2006;
      Thence South 44 East along said southerly limited access right-of-way line through said 265.58 acre tract, a distance of 72.55 feet to a point;
 
Thence through said 265.58 acre tract the following courses:
 
1.      South 00 West a distance of 99.48 feet to a point;
2.      South 44 East a distance of 198.20 feet to a point in a westerly line of that existing gas pipeline easement of record in Deed Volume 0637, Page 619;
3.      South 02 East along said westerly easement line, a distance of 29.77 feet to a point;
4.      North 44 West a distance of 228.64 feet to a point;
5.      North 00 East a distance of 99.56 feet to a point;
6.      North 44 West a distance of 84.96 feet to a point in the northerly line of said 265.58 acre tract;
Thence South 88 East along said northerly line, a distance of 28.80 feet to the place of beginning, containing 0.180 acre of land.

      Section 3.      That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
