.Explanation

The City Attorney entered into an agreement with Mark Ely, authorized by Ordinance 0278-2004 for a maximum amount of $46,450.00, to provide stalking investigative services pursuant to the Stalking Investigator Grant #241004.  These funds have been depleted and in order to continue these services it is necessary to increase the contract amount by $6,700.00 for a maximum contract amount of $53,150.00.    This amount is in accordance with the grant award.

Fiscal Impact

Funding for this contract will come from the Stalking Investigator Grant funds.

Emergency Designation:

This ordinance is being submitted as an emergency so that there will be no interruption in services.

Title

To authorize the City Attorney to modify an agreement for stalking investigative services with Mark W. Ely; to authorize the appropriation and expenditure of $6,700.00 from the Stalking Investigator Grant fund; to waive the competitive bidding provisions of the Columbus City Codes; and, to declare an emergency.  ($6,700.00)

Body

WHEREAS, Ordinance 0278-2004 authorized the City Attorney to enter into contract with Mark W. Ely for stalking investigative services; and

WHEREAS, funds have been depleted on the original contract; and

WHEREAS, it is in the best interests of the City to waive the competitive bidding provisions of Chapter 329 of the Columbus City Codes, 1959, relative to the procurement of professional services; and

WHEREAS, an emergency exists in the usual daily operation of the City Attorney's Office in that it is immediately necessary to modify a contract with Mark W. Ely to continue the provision of stalking case investigations and other related services as set forth in said contract, for an additional amount of Six Thousand Seven Hundred Dollars ($6,700.00) so that services are not interrupted and for the preservation of the public health, peace, property, safety and welfare; now therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS, OHIO

Section 1.  That the City Attorney be and hereby is authorized to modify a contract with Mark W. Ely for stalking investigative services in the amount of Six Thousand Seven Hundred Dollars ($6,700.00) in order to continue said services in accordance with the Stalking Investigator Grant #2003-WF-VA6-504.

Section 2. That for the reason stated in Section 1, the expenditure of $6,700.00, or so much thereof as may be necessary, is hereby authorized as follows: department 2401, Stalking Investigator Grant, grant number 241004, fund number 220, oca 241004, object level 1 - 03.

Section 3.  That the competitive bidding provisions of Chapter 329 of the Columbus City Codes, 1959, relative to the procurement of professional services are hereby waived.

Section 4.  That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten (10) days after passage if the Mayor neither approves nor vetoes the same.
