APPLICANT:  Forward Health LLC; c/o Alex Medvec; 6020 Groveport Road; Groveport, OH 43125

 

UNIVERSITY AREA COMMISSION: Approval.

 

UNIVERSITY IMPACT DISTRICT REVIEW BOARD RECOMMENDATION: Approval.

 

PROPOSED USE:  Medical office.

 

CITY DEPARTMENTS' RECOMMENDATION:  Approval. The site consists of one parcel developed with a rooming house in the AR-4, Apartment Residential District, and is subject to the University District Zoning Overlay (UDZO). The requested Council Variance will allow the existing building to be repurposed with a medical office. A Council variance is required because the AR-4 district does not allow medical office uses. Variances to required parking and lot width are also included in the request. The site is within the planning area of the University District Plan (2015), which recommends “Medium Intensity Residential” land uses at this location. Staff notes that the proposal is generally consistent with Plan’s design guidelines and with the existing mixed-use character of this portion of the North 4th Street corridor. Additionally, the proposed use will preserve a contributing structure that will remain externally unchanged.

To grant a Variance from the provisions of Sections 3333.035, AR-4 apartment residential district use; 3312.49, Required parking; and 3333.09, Area requirements, of the Columbus City Codes; for the property located at 1876 N. 4TH ST. (43201), to allow a medical office with reduced development standards in the AR-4, Apartment Residential District (Council Variance #CV24-086).

 

Body

 

WHEREAS, by application #CV24-086, the owner of property at 1876 N. 4TH ST. (43201), is requesting a Council variance to allow a medical office with reduced development standards in the AR-4, Apartment Residential District; and

 

WHEREAS, Section 3333.035, AR-4 apartment residential district use, does not allow commercial uses, while the applicant proposes to convert the existing building into a medical office containing 2,735 square feet; and

 

WHEREAS, Section 3312.49, Required parking, requires one parking spaces per 300 square feet of medical office space, or 10 spaces for a 2,735 square feet medical office, while the applicant proposes a total of eight provided parking spaces for the proposed use; and

 

WHEREAS, Section 3333.09, Area requirements, requires a minimum lot width of 50 feet in the AR-4, Apartment Residential District, while the applicant proposes to maintain a reduced lot width of 40 feet; and

 

WHEREAS, the University Area Commission recommends approval; and

 

WHEREAS, the University Impact District Review Board recommends approval; and

 

WHEREAS, the City Departments recommend approval because this request is generally consistent with University District Plan’s design guidelines and with the existing mixed-use character of this portion of the North Fourth Street corridor, and will preserve a contributing structure; and

 

WHEREAS, said ordinance requires separate submission for all applicable permits and Certificate of Occupancy for the proposed use; and

 

WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and

 

WHEREAS, the granting of said variance will not impair an adequate supply of light and air to the adjacent property, unreasonably increase the congestion of public streets, increase the danger of fires, endanger the public safety, unreasonably diminish or impair established property values within the surrounding area, or in any other respect impair the public health, safety, comfort, morals or welfare of the inhabitants of the City of Columbus; and

 

WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owner of the property located at 1876 N. 4TH ST. (43201) in using said property as desired; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That a variance from the provisions of Sections 3333.035, AR-4 apartment residential district use; 3312.49, Required parking; and 3333.09, Area requirements, of the Columbus City Codes; is hereby granted for the property located at 1876 N. 4TH ST. (43201), insofar as said sections prohibit a medical office in the AR-4, Apartment Residential District; with reduced parking from 10 spaces to eight spaces; and reduced lot width from 50 feet to 40 feet, said property being more particularly described as follows:

 

1876 N. 4TH ST. (43201), being 0.13± acres located on the east side of North 4th Street, 50± feet north of East 17th Avenue, and being more particularly described as follows:

 

Situated in the City of Columbus, County of Franklin, in the State of Ohio and being further described as follows:

 

Being Lot Number Six (6) of Block Number Eight (8) of Indianola Summit Addition, as the same is numbered and delineated upon the recorded plat thereof, of record in Plat Book 5, page 140,

Recorder's Office, Franklin County, Ohio.

 

SECTION 2.  That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for a 2,735± square feet medical office, or those uses allowed in the AR-4, Apartment Residential District.

 

SECTION 3.  That this ordinance is further conditioned upon the applicant obtaining all applicable permits and a Certificate of Occupancy for the proposed use.

 

SECTION 4. That this ordinance is further conditioned upon the applicant installing privacy fencing along the north and south boundaries of the parking area and a wooden lattice panel privacy screen on the northern side of the rear deck, both of which are located on the eastern side of the property.

 

SECTION 5.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
