Explanation

 

Rezoning Application:  Z24-027

 

APPLICANT:  Metro Development LLC, c/o Jeffrey L. Brown, Atty.; 37 West Broad Street, Suite 460; Columbus, OH 43215.

 

PROPOSED USE:  Multi-unit residential development.

 

DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (4-1) on October 10, 2024.

 

WESTLAND AREA COMMISSION RECOMMENDATION: Approval.

 

CITY DEPARTMENTS' RECOMMENDATION:  Disapproval. The 21.06± site consists of one undeveloped parcel in the M, Manufacturing District. The applicant requests the L-AR-1, Limited Apartment Residential District to allow a 408-unit apartment complex. The limitation text includes commitments to a maximum number of dwellings units, garage height, setbacks, and traffic improvements. Additionally, the applicant has included commitments to develop the site in accordance with the submitted site plan and building elevations. The proposed residential development is not consistent with the Westland Plan’s (1994) land use recommendation for “Industrial/Manufacturing” uses at this location. The Plan recognizes the site as part of an “Industrial/Office” district, and is within an established development pattern zoned for manufacturing and commercial uses. A concurrent Council variance (Ordinance #3328-2024; CV24-079) has been filed to reduce the building setback and increase the height of private garages.

WHEREAS, application #Z24-027 is on file with the Department of Building and Zoning Services requesting rezoning of 21.06± acres from M, Manufacturing District, to the L-AR-1, Limited Apartment Residential District; and

 

WHEREAS, the Development Commission recommends approval of said zoning change; and

 

WHEREAS, the Westland Area Commission recommends approval of said zoning change; and

 

WHEREAS, the City Departments recommend disapproval of the zoning change because the requested L-AR-1, Limited Apartment Residential District is inconsistent with the Westland Plan’s land use recommendation for “Industrial/Manufacturing” uses at this location, and with the established zoning and development pattern of this area; now, therefore:   

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

 

5255 CROSSWIND DR. (43228), being 21.06± acres located on the southeast corner of Crosswind Drive and Krieger Street, and being more particularly described as follows:

 

Situated in the State of Ohio, County of Franklin, City of Columbus and being in Virginia Military Survey Number 1462 and also being 21.06± acres of a 23.560 acre tract as conveyed to Capital Square, LTD. in Instrument Number 199712310179272 as further described as follows;

 

Commencing at an angle point in the south line of said 23.560 acre tract, being the northeast corner of Georgesville Road (R/W Varies) as create in the Dedication of Kreiger Street, Crosswind Drive and Georgesville Road in Plat Book 49, Page 35, the northwest corner of Georgesville Road as created in the Dedication of Georgesville Road, Hall Road & Boltonfield Street in Plat Book 45, Page 68;

 

Thence with the south line of said 23.560 acre tract and the northerly right of way line of Georgesville Road as dedicated in said Plat Book 49, Page 35, S 76° 37' 36" W, 38.95± feet to the TRUE POINT OF BEGINNING for the land herein described as follows;

I. INTRODUCTION: The site is located on the north side of Georgesville Road between Boltonfield Street and Kreiger Street.  The site is surrounding by public streets.  There is a large water retention area in the middle of the site which impacts development opportunities.

 

II. PERMITTED USES: Those uses permitted in Section 3333.02, AR-12, ARLD and AR-1 apartment residential district use of the Columbus City Code.

 

III. DEVELOPMENT STANDARDS: Unless otherwise indicated in the submitted text or drawings the applicable development standards are contained in Chapter 3333 of the Columbus City Code.

 

A. Density, Height, Lot, and/or Setback Commitments:

 

1. The maximum number of dwelling units shall be 408.

 

2. The height of the garages is increased from 15 to 16 feet (see CV24-079).

 

3. The building setback from Georgesville Road is reduced from 80 to 25 feet (see CV24-079).

 

B. Access, Loading, Parking and/or other Traffic Related Commitments:

 

1. At the intersection of Georgesville Road and Krieger Street, the developer shall construct a west bound right turn lane with a length of 225 feet (inclusive of 50 foot diverging taper.)

 

2. The developer shall construct adequate off-site pedestrian infrastructure to connect the site to COTA bus stops #7333 and #7966 provided there is currently sufficient right of way for any pedestrian infrastructure.

 

C. Buffering, Landscaping, Open Space, and/or Screening Commitments:

 

N/A.

 

D. Building Design and/or Exterior Treatment Commitments:

 

The buildings shall be constructed in accordance with the submitted building elevations.  The building elevations may be slightly adjusted to reflect engineering, topographical, or other site data developed at the time of the development plan and when engineering and architectural drawings are completed.  Any slight adjustments to the building elevations shall be subject to review and approval by the Director of the Department of Building and Zoning Services, or a designee, upon submission of the appropriate data regarding proposed adjustment.

 

E. Lighting and/or other Environmental Commitments:

 

N/A.

 

F. Graphics and/or Signage Commitments:

 

All graphics and signage shall comply with the Graphics Code, Article 15, Title 33 of the Columbus City Code as it applies to the AR-1 zoning classification and any variance to those requirements will be submitted to the Columbus Graphics Commission for consideration.

 

G. Miscellaneous Commitments:

 

Site Plan Revision Allowance.  The Property shall be developed in accordance with the Site Plan; however, the Site Plan may be slightly adjusted to reflect engineering, topographical, or other site data established at the time of development and engineering plans are completed.  The Director of the Department Building and Zoning Services or the Director’s designee may approve any slight adjustment to the Site Plan upon submission of the appropriate data regarding the proposed adjustment.

 

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
