Explanation
1.      BACKGROUND:
 
A. Need. This legislation authorizes the Director of Public Utilities to enter into an agreement with McDaniel's Construction Corp., Inc., 1069 Woodland Avenue, Columbus, Ohio 43219, for construction services; to encumber funds with the Transportation Division for testing, prevailing wage coordination and street marking services for the Noe Bixby Road Culvert Replacement Project, in the amount of $170,762.08.

B.      Bid Information.  The projects were advertised in the City Bulletin on December 14, and December 21, 2002. Nine bids were received on January 8, 2003, as follows:

D.      Emergency Designation:  Emergency designation is requested for this ordinance so that the subject construction contract may be executed to allow the firm to begin construction during this construction season.
 
2.      FISCAL IMPACT:
 
A.      Budgeted Amount: There are sufficient funds and authority available for this expenditure/CIB amendment.
 
B.      Contract Amount:  The amount of the contract is the amount of the proposed contractor's bid.  However, it is entirely usual and it is reasonable to expect that this contract may later require modification in order to adjust for changed conditions, unknown conditions, operational failures during construction, and other problems that are not known at this time.
 
The project funding that is needed is as follows:
 
Construction contract                $163,262.08
Testing Services                            $4,000.00
Prevailing wage coordination         $1,000.00
Street Marking                      $2,500.00

Body
WHEREAS,  bids for construction of the Noe Bixby Road Culvert Replacement Project were received January 8, 2003, and
 
WHEREAS,      it is necessary to authorize the Director of the Department of Public Utilities to award and execute a construction contract and to encumber and expend funds to provide for payment of testing, prevailing wage coordination, and street marking services for costs associated with the Noe Bixby Road Culvert Replacement Project.  This will allow the construction services to begin at the earliest practicable date.
 
WHEREAS,      an emergency exists in the usual daily operations of the Division of Sewerage and Drainage, Department of Public Utilities, in that it is immediately necessary to authorize the Director of Public Utilities to contract for the aforementioned project for the preservation of the public health, peace, property and safety; now therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.      That the Director of Public Utilities be, and hereby is, authorized to award and execute a contract for construction of the Noe Bixby Road Culvert Replacement Project with the lowest and best bidder, McDaniel's Construction Corp., Inc., 1069 Woodland Avenue, Columbus, Ohio 43219, in the amount of $163,262.08 in accordance with the terms and conditions of the Contract on file in the office of the Division of Sewerage and Drainage; and to obtain the necessary testing prevailing wage coordination, and street marking services from the Transportation Division; and to pay up to a maximum of $7,500.00.
 
Section 2.      That for the purpose of paying the cost of the construction contract, the cost of the testing prevailing wage coordination, and street marking services, the following expenditure, or as much thereof as may be needed, is hereby authorized as follows:  Division 60-15, Fund 685, Project 610720, Object Level Three 6621, OCA Code 685720, Amount $170,762.08
 
Section 3.        That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
