Explanation
 
Rezoning Amendment Z05-019A
 
Ordinance #1274-2005, passed July 25, 2005, rezoned 2.72+ acres from the R, Rural District to the PUD-4, Planned Unit Development District.  That legislation permits the development of ten single-family dwellings in accordance with a registered site plan and specific development standards including a commitment to preserve specific trees that were subsequently removed.  This legislation will amend Ordinance #1274-2005, passed July 25, 2005, by modifying the landscaping commitments as negotiated with the neighbors and the Northwest Civic Association as well as well as removing the provision allowing the Board of Zoning Adjustment to hear variances to this plan.  All other development standards and commitments contained in Ordiance #1274-2005 are unchanged by this ordinance and will remain in effect.

Body
 
WHEREAS, Ordinance #1274-2005, passed July 25, 2005, rezoned 2.72+ acres from the R, Rural District to the PUD-4, Planned Unit Development District; and
 
WHEREAS, that legislation permits the development of ten single-family dwellings in accordance with a registered site plan and specific development standards including a commitment to preserve specific trees which were subsequently removed; and
 
WHEREAS, this ordinance will amend Ordinance #1274-2005, passed July 25, 2005, by modifying the landscaping commitments as negotiated with the neighbors and the Northwest Civic Association; and
 
WHEREAS, this ordinance will amend Ordinance #1274-2005, passed July 25, 2005, by eliminating the provision allowing the Board of Zoning Adjustment to hear variances to this plan; and
 
WHEREAS, this ordinance will amend Ordinance #1274-2005, passed July 25, 2005, by allowing existing parcel lines to remain since this project is located in two different tax districts but for the purpose of zoning the project shall be considered one parcel; and
 
WHEREAS, all other development standards and commitments contained in Ordinance #1274-2005 are unchanged by this ordinance and will remain in effect; and
 
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1. That the existing Section 3 of Ordinance #1274-2005, passed on July 25, 2005 (Z05-019) be hereby repealed and replaced with a new Section 3 reading as follows:
 
"SECTION 3.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division and shall register a copy of the approved PUD-4, Planned Unit Development District and Application among the records of the Building Services Division as required by Section 3311.12 of the Columbus City Codes; said plans being titled, "SLATEY HOLLOW SINGLE FAMILY CONDOMINIUMS," and "SLATEY HOLLOW ENTRANCE LANDSCAPING PLAN," both signed by Donald Plank, Attorney for the Applicant and David B. Perry, Agent for the Applicant and dated July 12, 2006."
 
SECTION 2.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
