Explanation
 
1.  BACKGROUND  
This legislation authorizes the Director of Public Service to accept the assignment of a contract currently held by Nationwide Children's Hospital with Evans, Mechwhwart, Hambelton, and Tilton (EMH&T) for the Parsons/Livingston Avenue Improvement project and authorizes the Director of Public Service to execute a professional engineering contract modification agreement between the City of Columbus and EMH&T for the Parsons-Livingston Avenue Improvement Project.  
 
Nationwide Children's Hospital previously entered into a professional services contract with EMH&T for Design Services for this project and funded design.  The City of Columbus will utilize American Recovery and Reinvestment and Act (ARRA) funds to fund the construction and administration of the project.   Design service  contracts customarily do not include services during construction.  Therefore, once the contract is assigned to the City, the City must modify the subject contract with EMHT for services during construction, to include technical engineering and consultant services and creation of record plan drawings.
 
The purpose of this public improvement project is to widen and improve Livingston Avenue from Ninth Street east to Ohio Avenue and to widen and improve Parsons Avenue from Jackson Street north to a point approximately 200 feet north of Kennedy Drive.  This project includes full depth pavement replacement, installation of traffic medians and installation of upgraded tree lawns, street lighting, sidewalks and ADA compliant ramps.  
 
2.  FISCAL IMPACT
This legislation authorizes funding in the amount of $60,000.00 for the above mentioned contract.   Funding for this contract is available within the Street and Highway Improvement Fund.
 
3.  Emergency Justification
This project has been identified as a Federal stimulus package project.  Emergency action is necessary to maintain the city's ability to fulfill the project scheduling requirements of the stimulus funding.

Body
WHEREAS, Nationwide Children's Hospital currently has a contract with EMH&T for the Design of the Parsons /Livingston Avenue Improvement Project; and
 
WHEREAS, it is necessary to assign this contract to the City of Columbus, in order that the Division of Design and Construction may administer the remaining portion of the contract; and
 
WHEREAS, it is also necessary to authorize the City of Columbus to execute a professional engineering services agreement with Nationwide Children's Hospital, in order to provide engineering services during the construction phase of this project; and
 
WHEREAS, this ordinance authorizes the above mentioned assignment and agreement; and
 
WHEREAS, it is necessary to authorize the expenditure of funds for professional engineering services necessary to complete this project; and
 
WHEREAS, it is necessary to waive the competitive bidding provisions of the Columbus City Code with respect to professional services due to the consultant's knowledge and understanding of this project as the design firm; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Design and Construction in that this project has been designated a part of the American Recovery and Reinvestment Act of 2009 and it is immediately necessary to authorize this assignment and expenditure for the project to remain on schedule thereby preserving the Federal funds and preserving the public health, peace, property, safety and welfare; now, therefore
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Director of Public Service is hereby authorized to accept the assignment of a contract with EMH&T, currently held by Nationwide Children's Hospital.
 
Section 2.  That the Director of Public Service is hereby authorized to execute a professional engineering services agreement modification with EMH&T, 5500 New Albany Road, Columbus, OH 43054, for professional engineering services during construction.
 
Section 3. That from the unappropriated monies in the Street and Highway Improvement Fund, No. 766, and from all monies estimated to come into said funds from any and all sources, and unappropriated for any other purpose during the fiscal year ending December 31, 2010, the sum of $60,000.00 is hereby appropriated as follows:

Section 5.  That the sum of $60,000.00 be and hereby is appropriated from the unappropriated balance of Fund 765, the Federal-State Highway Engineering Fund, and from all monies estimated to come into said funds from any and all sources and unappropriated for any other purpose during the fiscal year ending December 31, 2010 as follows:

Section 6.   That the monies appropriated in the foregoing Section 5 shall be paid upon order of the Director of Public Service and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.
 
Section 7.  That the expenditure of $60,000 or so much thereby as may be needed is hereby authorized as follows to provide funding for the contract mentioned above.

Section 8.  That this Council finds it in the best interests of the City of Columbus that the formal competitive bidding provisions of Section 329 of the Columbus City Code, 1959 be waived.
 
Section 9.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
