Explanation
BACKGROUND:
The Department of Technology established a contract with Liebert Corporation, Ordinance No. 1160-2006, with the only authorized local service center for the batteries and UPS (Un interruptible Power Systems), used by the City's Department of Technology computer centers. This contract provided for maintenance and related services. Ordinance No. 1160-2006 provided language that allows for renewals at the conclusion of the ending term agreed upon note in contract document EL006410 that was approved by City Council on July 10, 2006.
The purpose of this ordinance is to modify and extend the contract for continual maintenance of batteries and UPS used by the Department of technology for its computer related systems.
Liebert Corporation's has officially changed its name and Federal Identification number to - Liebert Global Services FID 43-1798453. This ordinance thereby request authorization to transfer all outstanding contracts previously approved with Liebert Corporation to Liebert Global Services, FID 43-1798453, Contract Compliance expiration date 02/23/2009.
The Director of Technology respectfully request approval of this ordinance to allow the Department of Technology to modify and extend its annual maintenance service agreement in accordance with the terms and conditions established in the original agreement.
This agreement will cost $31,216.10 for maintenance and related services for the UPS.
FISCAL IMPACT: Previous contracts for 2006 designated a total of $37,691.00 for services related to the UPS system, with Liebert Corporation. Funding for this modification is budgeted and available within the 2007 Department of Technology's internal services fund's budget. This modification will cover twelve months of service ending April 18, 2008. Approval of this ordinance will bring the contract aggregate total to $68,907.10
EMERGENCY: Emergency legislation is requested to expedite authorization of this contract in order to facilitate uninterrupted services from the supplier.

Title
To authorize the Director of the Department of Technology to modify past, present and future contracts and purchase orders with Liebert Corporation to Liebert Global Services, for maintenance and related services associated with batteries and the UPS (Uninterrupted Power Supply); to authorize the expenditure of $31,216.10 from the Department of Technology internal service fund; and to declare an emergency ($31,216.10)
Body
WHEREAS, this ordinance will provide for the change of the company Federal Identification number and company name for contracts and purchase orders currently in process and established with Liebert Corporation.; and
WHEREAS, approval of this ordinance will allow the Director of the Department of Technology to continue utilizing services provided by Liebert Global Services, associated with an annual maintenance service agreement in accordance with the terms and conditions established in the original agreement; and
WHEREAS, this ordinance authorizes the assignment of all current contracts between the City of Columbus with Liebert Corporation, FID 31-0715256 to Liebert Global Services FID 43-1798453; and
WHEREAS, funding for this contract is budgeted and available within the 2007 Department of Technology's internal services fund's budget; and
WHEREAS, an emergency exists in the usual daily operation of the City in that it is immediately necessary to authorize the passage of this ordinance to continue uninterrupted support for services related to the UPS system, thereby preserving the public health, peace, property, safety, and welfare; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1: That the Director of the Department of Technology be and is hereby authorized to modify all active contracts and purchase orders pursuant to those contracts to reflect the change of the company name FID number from Liebert Corporation 31-0715256 to Liebert Global Services FID 43-1798453; associated with a contract for maintenance and related services for the batteries and UPS (Uninterrupted Power Supply), with Liebert Global Services.
SECTION 2: That the expenditure of $31,216.10 or so much thereof as may be necessary is hereby authorized to be expended from:
