Explanation
This legislation authorizes the City Attorney to modify an agreement for special legal counsel services with representatives of the law firm of Moots, Cope & Hogan, and to expend the sum of $15,000.00 from the General Fund. A previous agreement in the amount of $15,000.00 was authorized on 7/29/02 by Ordinance 1320-02 under the name of Moots, Cope & Carter. Said law firm has susequently changed its name to Moots, Cope & Hogan.
This legislation is requested to be an emergency so that funding will be made available as soon as possible so there is no break in the provision of services.
FISCAL IMPACT: Sufficient appropriation is available in Object Level One 03 for this requested expenditure.

Title
To authorize the City Attorney to modify an agreement for special legal counsel services with representatives of the law firm of Moots, Cope & Hogan, formerly known as Moots, Cope & Carter, to authorize the expenditure of the sum of Fifteen Thousand Dollars and no/cents ($15,000.00), and to declare an emergency.
Body
WHEREAS, funds are available in the General Fund within the office of the City Attorney for various legal expenses, and
WHEREAS, the City of Columbus has certain litigation pending in the Franklin County Common Pleas Court; and
WHEREAS, it has been necessary for the City to obtain special legal counsel services to assist it in such litigation and to that end Council on July 29, 2002, by Ordinance No. 1320-02 did authorize the City Attorney to enter into an agreement with representatives of the law firm of Moots, Cope & Carter to provide for such services; and
WHEREAS, an emergency exists in the usual daily operations of the City in that it is immediately necessary for the public peace, property, health, safety and welfare of the City to enable the City Attorney to modify the contract for such services to provide for the continued assistance to the City; now therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS, OHIO:
SECTION 1. That the City Attorney be and hereby is authorized to modify Contract No. EL-002605 with representatives of the law firm of Moots, Cope & Hogan, formerly known as Moots, Cope & Carter, for special legal counsel services in connection with litigation pending in the Franklin County Common Pleas Court.
SECTION 2. That the City Attorney be and hereby is authorized and approved to expend Fifteen Thousand Dollars and no/cents ($15,000.00), or so much thereof as may be necessary, in accordance with the terms and conditions of such agreement as follows:

SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten (10) days after passage if the Mayor neither approves nor vetoes same.
