Explanation

1.  BACKGROUND:

This legislation authorizes the Director of Public Utilities to execute a final construction contract modification with Mid Ohio Pipeline, Inc., in connection with the Castle Rd. Force Main Discharge Point Relocation Project.

The original contract was funded through a loan from the Ohio Water Development Authority, and a supplemental loan after an initial attempt at installing the line failed.  This modification is required to pay for a final successful effort at installing the force main under Interstate 71, utilizing a pipe-ramming process.  The use of Voted Sanitary Bond Funds will provide the funding required to process a final payment, and to officially close this project.  (For Further Information See ORD0331-2006LegislationAttachment.doc)

2.  FISCAL IMPACT:

The Division requests the authority to expend voted sanitary bond funds to process this final payment to the construction contractor.  Funding for this expenditure was included within the Fall, 2005 Bond Sale.  

Title

Body

WHEREAS, the Ohio Water Development Authority approved a loan to the City of Columbus on  December 13, 2001 in the amount of $425,616.01, identified as OWDA Loan No. 3571; and

WHEREAS, Ordinance No. 0481-02, passed the 15th day of April 2002, authorized the Director of Public Utilities to execute a contract with Mid-Ohio Pipeline, Inc., for the  construction of the Castle Road 16-inch Force Main-Discharge Point Relocation Project; and

WHEREAS, on September 25, 2003, the Ohio Water Development Authority approved Supplemental Loan No. 3962 in the amount of $342,685.00 for purposes of paying the cost of conventional tunneling methods to accomplish the installation of the subject infrastructure; and

WHEREAS, the due to failed attempts at installing the force-main using directional drill and cased-auger methods, division engineering personnel in consultation with its design engineer determined it necessary to attempt another installation using pipe ramming technology, which successfully completed the installation of this vital sanitary infrastructure project ; and

WHEREAS, it is necessary for this City Council to authorize the transfer of funds within the Voted Sanitary Sewer Bond Fund, pursuant to authorizing the Director of Public Utilities to execute a final contract modification that is necessary to provide for the final payment of construction services that were required to allow for the successful installation and completion of the Castle Road Force Main Discharge Point Relocation Project; and to authorize and amendment to the 2005 Capital Improvements Budget to accomodate same; at the earliest practicable date allowed by law; now, therefore;

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

Section 1.  That the Director of Public Utilities be, and hereby is, authorized to modify original City Auditor's Contract No. EL002260 with Mid Ohio Pipeline, Inc., PO Box 3049, Lexington, OH 44904; pursuant to issuing a final payment in connection with the Castle Road Force Main Discharge Point Relocation Project in accordance with the terms and conditions shown within the contract modification on file in the Sewer System Engineering Section Offices of the Division of Sewerage and Drainage.

Section 2.  That for the purpose of paying the cost of the said contract modification, the following expenditure, or as much thereof as may be needed, be and the same is hereby authorized from the Voted Sanitary Bond Fund No. 664| Div.: 60-05 as follows:

Project No. 650642| OCA Code 642918| Obj. Level 3: 6630| Amount $153,240.00.

Section 3.  That the 2005 Capital Improvements Budget Ordinance No. 1070-2005 is hereby modified as follows, to provide sufficient budget authority for the execution of the modification of the construction contract stated in Section 1 herein.
