Explanation
 
Background:
      -      Bids were received by the Recreation and Parks Department on June 8, 2004, for the Livingston Park Improvement Project, as follows:

      -      Project includes pavement improvements and landscaping.
      -      The Contract Compliance Number for McDaniels Construction, is #31-1145406.
      -      The approximate cost of Recreation and Parks staff time on this project is $4,000.00 (03-021).
      -      A contingency amount of $5,032.00 is being included in this project.
      -      Emergency action is necessary as sidewalk and pavement is in poor condition and presents a safety issue.
Fiscal Impact:
-      $100,000.00 is required and budgeted within the Voted 1995 and 1999 Parks and Recreation Bond Fund to meet the financial obligation of this contract.

To authorize and direct the Director of Recreation and Parks to enter into contract with McDaniels Construction, for the Livingston Park Improvements Project, to authorize the expenditure of $100,000.00 from the Voted 1995 and 1999 Parks and Recreation Bond Fund, and to declare an emergency.  ($100,000.00)
 
Body
 
      WHEREAS, bids were received by the Recreation and Parks Department on June 8, 2004, and the contract for the Livingston Park Improvements Project will be awarded on the basis of the lowest and best responsive and responsible bidder; and
 
      WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to enter into said contract as the sidewalk and pavement are in poor condition and have created a safety issue; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
      Section 1.   That the Director of Recreation and Parks be and he is hereby authorized and directed to enter into contract with McDaniels Construction, for the Livingston Avenue Improvements Project, in accordance with plans and specifications on file in the Recreation and Parks Department.
 
      Section 2.   That the expenditure of $100,000.00, or so much thereof as may be necessary, be and is hereby authorized from the Voted 1995 and 1999 Recreation and Parks Bond Fund 702, Dept. 51-01, to pay the cost thereof.

Section 3.   That for the purpose of paying for any contingencies which may occur during this project, the amount of $5,032.00 has been included in Section 2, above.  This amount will be expended only after approval by the Director of the Recreation and Parks Department, certification by the City Auditor, and approval of the City Attorney.
 
Section 4.   That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
 
      Section 5.   That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
