Explanation
This legislation authorizes a design contract modification with Pomeroy and Associates, Limited, for the Binns/Champion/Hollenback Improvement project.  This project originally consisted of roadway rehabilitation with the primary purpose of storm drainage improvements at three separate locations, Binns Boulevard from Briggs Road to Vanderberg Avenue; Champion Avenue from Hilock Road to Williams Road; and Hollenback Road from North High Street to Milton Avenue.  The Binns Boulevard work was abandoned after engineering studies suggested that a more extensive sub-surface project would be necessary to deal with drainage problems at that location.  The Hollenback Drive and Champion Avenue locations were split into separate plans in order to accelerate the construction schedule of Hollenback Drive.  The work to be done on each project includes new roadways, curbs and gutters, sidewalks, curb ramps, striping, signage and drainage inlets.
 
This contract modification is necessary to reflect the City's revisions in scope and standards that have impacted this project.  During the design phase, the City's Construction and Material Specifications were revised and the Electricity Division changed its specifications substantially.  The evolution of curb ramp standards caused additional design work at North High Street and Hollenback, a signalized intersection.  Changes in sidewalk standards per the Americans with Disabilities Act (ADA) forced property acquisitions on Champion Avenue, requiring a number of additional exhibits and descriptions of proposed right-of-way.  The splitting of Champion Avenue and Hollenback Drive as separate sets of plans for bidding purposes required retrofitting the plans to this end.
 
Pomeroy and Associates, Limited, CC #31-1568332 (expires February 25, 2008) was selected in 1997 in accordance with Chapter 329 for professional service contracts.  We have negotiated new hourly rates for this modification because the current contract is eight (8) years old.  Costs have increased by approximately three percent (3%) per year for the past eight years.  The overhead rate and percentage of profit from the original contract were used because they are still valid.  The original contract amount was for $121,173.00.  There have been three previous contract modifications that totaled $55,501.50.  The total of all modifications including this one is $95,381.50.  The contract amount including all modifications is $216,554.50.
 
Fiscal Impact:  The Transportation Division budgeted $40,000 in the 2005 Capital Improvements Budget for preparation of construction plans for the Champion/Hollenback Improvement project.  Actual funds will be available under the Roadway Improvements in the 1995, 1999 Voted Streets and Highways Fund as a result of the Fall 2005 bond sale.  This ordinance authorizes an expenditure of $39,880.00.
 
Emergency action is requested for immediate modification of the design contract for the earliest possible completion of the design in order to maintain the construction schedule.

Body
WHEREAS, Contract CT-18235 was authorized by Ordinance 0929-1997, passed April 14, 1997, executed May 28, 1997 and approved by the City Attorney on June 2, 1997; and
 
WHEREAS, this contract was subsequently modified and increased by Ordinance 2652-1998, passed October 19, 1998 ($21,170.42); Ordinance 2544-2000, passed November 20, 2000 ($9,351.08) and Ordinance 1594-2001, passed September 24, 2001 ($24,980.00); and
 
WHEREAS, it is necessary to again modify this contract in order to increase the scope of services as per the consultant's letter dated May 28, 2004 for the Champion/Hollenback Improvement project; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that the contract should be modified and increased immediately so that the work may proceed without delay for the earliest possible completion of the design in order to maintain the construction schedule, thereby preserving the public health, peace, property, safety and welfare; now therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Public Service Director be and hereby is authorized to modify and increase Contract CT-18235, now known as XC819317, with Pomeroy and Associates, Limited, 599 Scherers Court, Worthington, Ohio 43085, to complete the design, construction plans and permits for the Champion/Hollenback Improvement project in accordance with the plans on file in the office of the Public Service Director.
 
SECTION 2.  That for the purpose of paying the cost of the contract modification the sum of $39,880.00 or so much thereof as may be necessary be and hereby is authorized to be expended from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6682, OCA Code 644385 and Project 530161.
 
SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
