Title: To authorize the Director of Public Service to execute a professional service contract modification with American Structurepointe, Inc. for the engineering of the General Engineering 2008 contract; to amend the 2011 C.I.B.; to authorize the appropriation and expenditure of up to $91,868.00 from the Street and Highway Improvement Fund; and to declare an emergency. Explanation

1.  BACKGROUND 

This legislation authorizes the Director of Public Service to modify and increase the professional engineering services contract for the General Engineering 2008 Contract with American Structurepointe Inc., in the amount of $91,868.00. 

 

This contract has been used for various projects that spent down the total value.  The intent of this contract was to provide the Department of Public Service with continuing, contractual access to additional resources that are necessary to perform various professional engineering, survey and technical expertise for the department to complete its capital and operating budget commitments.

The projects developed under this program are typically small to moderate size improvements, and frequently include a significant emphasis on pavement rehabilitation, curb replacement, sidewalks, curb ramps, drainage, minor rehabilitations, and aesthetic improvements.  This contract has been used for quick response design services. 

Work to be performed as part of this modification includes design of a solution to drainage issues on McKinley Avenue from 5th Avenue to Trabue Road.  Other work to be included in this modification consists of reprofiling Hayden Run Road from Edwards Farm Road to Camden Place Drive to prepare the road for resurfacing.

 

The original contract amount was  $250,000.00    Contract number EL008325.  Established by ordinance 0563-2008

Ordinance 0293-2010 authorized the first modification to this contract to remove the 2 year timeframe.

This is the second modification to this contract in the amount of $91,868.00

The total contract amount including this modification is $341,868.00

 

2.  CONTRACT COMPLIANCE

The Contract Compliance number for American Structurepointe, Inc. is 351127317 and it expires 11/23/11.

 

3.  EMERGENCY DESIGNATION

Emergency action is requested so that the design work for the flooding issue on McKinley Avenue can proceed as soon as possible to perform necessary upgrades and safety improvements for the local community.

 

4.  FISCAL IMPACT

The amount of this modification is $91,868.00.  Funding for this modification is available within the Street and Highway Improvement Fund.

Body

WHEREAS, ordinance 1369-2010 authorized the Director of Public Service to enter into contract for the General Engineering 2008 contract; and

 

WHEREAS, the Director of Public Service has identified the need to modify this contract with American Structurepointe, Inc. for the design of a solution to drainage issues on McKinley Avenue from 5th Avenue to Trabue Road and reprofiling Hayden Run Road from Edwards Farm Road to Camden Place Drive to prepare the road for resurfacing; and 

 

WHEREAS, a satisfactory proposal has been received by American Structurepointe, Inc. for this modification; and

 

WHEREAS, it is necessary to amend the 2011 Capital Improvement Budget; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Design and Construction, in that the design services contract should be modified immediately in order to design needed drainage improvements to resolve flooding issues within the project area, thereby preserving the public health, peace, prosperity, and welfare; now, therefore

 

BE IT ORDAINED BY THE CONCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of Public Service be and is hereby authorized to execute a professional services contract modification for the Division of Design and Construction with American Structurepointe, Inc., 2550 Corporate Exchange Drive, Suite 300, Columbus, OH 43231, in an amount up to $91,868.00 for engineering services associated with the General Engineering 2008 contract.

 

SECTION 2.  That the 2011 Capital Improvements Budget established within ordinance 0266-2011 be and hereby is amended due to cancellations as follows:

SECTION 3.   The sum of $91,868.00   be and is hereby appropriated from the unappropriated balance of the Street and Highway Improvement Fund, Fund 766, and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ending December 31, 2011, as follows

SECTION 4.   That the monies appropriated in the foregoing Section 3 shall be paid upon order of the Director of  Public Service and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.

 

SECTION 5.  That for the purpose of paying the cost of this contract modification, up to $91,868.00 or so much thereof as may be needed, is hereby authorized to be expended from the Street and Highway Improvement Fund, No. 766 as follows:

SECTION 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 7.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
