Explanation   

1.  BACKGROUND

This ordinance authorizes the Director of Public Utilities to enter into a contract with DLZ Ohio, Inc. for professional services and services during construction for the Broadview Road 30-Inch Transmission Main project, CIP #690502-100002, in an amount up to $483,898.01.

 

The Division of Water is responsible for providing quality, reliable water for consumer use and adequate volume for fire protection.  This project will help to meet these responsibilities.  The Broadview 30-Inch Transmission Main is planned to meet future demands of the system, provide additional resilience in providing water quality, and provide a more reliable water system to our customers.  

 

This contract is for engineering consulting services for the design of a water distribution transmission main that will extend from a 48-Inch Transmission Main in the North pressure district along Cherry Bottom Rd at the Broadview Rd intersection to a connection point in the City’s existing water distribution system, specifically the Morse pressure district. 

 

All of the transmission main will be located inside the City of Columbus, specifically in the Rocky Fork-Blacklick - 33 Community. 

 

TIMELINE:  The duration of the initial contract for Phase 1 - Preliminary Design Services is 10 months and is expected to begin in September, 2023.  Phase 2 - Detailed Design Services (Modification No. 1) is expected to have a duration of approximately 10 months.  Phase 3 - Engineering Services during Construction (Modification No. 2) is expected to have a duration of approximately 12 months.  May, 2026 is the estimated ending date of the agreement based on the total term.

 

ESTIMATED COST OF PROJECT:  The original engineering agreement amount is $483,898.01. Two additional contract modifications are anticipated at this time.

2.  ECONOMIC IMPACT/ADVANTAGES; COMMUNITY OUTREACH; PROJECT DEVELOPMENT; ENVIRONMENTAL FACTORS/ADVANTAGES OF PROJECT

This project will ensure a sufficient and resilient water supply for the future demands that are projected in the North-East portion of the distribution system.

 

3.  BID INFORMATION

This project was formally advertised on the Vendor Services and Bonfire websites and opened April 28, 2023.   Three proposals were received:

All proposals were deemed responsive.  The evaluation committee reviewed the proposals and recommended the contract for the Broadview Road 30-Inch Transmission Main project be awarded to DLZ Ohio, Inc.

 

DLZ Ohio, Inc.’s certification was in good standing at the time of the contract award.

 

4.  CONTRACT COMPLIANCE INFORMATION

DLZ Ohio, Inc.’s contract compliance number is CC004939 and expires 4/29/24. Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against DLZ Ohio, Inc.

 

5.  MINORITY AND WOMAN OWNED BUSINESS ENTERPRISE & SMALL LOCAL BUSINESS ENTERPRISE PROGRAM

This contract was bid with an anticipated City of Columbus MBE/WBE Program goal of 15% as assigned by the City’s Office of Diversity and Inclusion (ODI).  After ODI’s review of the Utilization Plan and other related information the contractor submitted with their bid response, ODI has approved an MBE/WBE Program goal of 15% for this contract.  Failure by the contractor to meet this goal subjects the contractor to the Penalties for Non-Compliance as described in the bid documents for this contract.

 

As part of their proposal, DLZ Ohio, Inc. has proposed the following four subcontractors to perform contract work:

6.  FISCAL IMPACT

Funding in the amount of $483,898.01 is available and appropriated within the Water Bond Fund, Fund 6006.  An amendment to the 2023 Capital Improvement Budget is needed to align budget authority with the proper project. Amendments to the 2023 Capital Improvement Budget are contingent upon approval of the 2023 Capital Improvement Budget.

Body

WHEREAS, the Department of Public Utilities is engaged in the Broadview Road 30-Inch Transmission Main project; and

 

WHEREAS, four proposals for the Broadview Road 30-Inch Transmission Main project were received and evaluated by the evaluation committee; and

 

WHEREAS, the evaluation committee recommended DLZ Ohio, Inc. be awarded the contract for this project; and

 

WHEREAS, it is necessary to authorize the Director of the Department of Public Utilities to enter into a professional services contract with DLZ Ohio, Inc. for the Broadview Road 30-Inch Transmission Main project; and

 

WHEREAS, the 2023 Capital Improvements Budget must be modified to align budget authority with the proper project; and

 

WHEREAS, it is necessary to authorize an expenditure of funds from the Water Bond Fund, Fund 6006, to pay for the contracted services for the project; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the 2023 Capital Improvements Budget authorized by Ordinance 1711-2023 be amended as follows to establish sufficient budget authority for this project:

SECTION 2.  That the transfer of $183,898.01, or so much thereof as may be needed, is hereby authorized within the Water Bond Fund, Fund 6006, per the accounting codes in the attachment to this ordinance.

 

SECTION 3.  That the Director of Public Utilities is hereby authorized to enter into a professional services and construction services contract for the Broadview Road 30-Inch Transmission Main project with DLZ Ohio, Inc., 6121 Huntley Road, Columbus, OH 43229, in an amount up to $483,898.01, in accordance with the terms and conditions of the contract on file in the Department of Public Utilities.

 

SECTION 4.  That the expenditure of $483,898.01, or so much thereof as may be needed, is hereby authorized to pay for this contract per the accounting codes in the attachment to this ordinance.

 

SECTION 5.  Funds are hereby deemed appropriated and expenditures and transfers authorized to carry out the purposes of this ordinance and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 7.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 8.  That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
