Explanation
BACKGROUND: The City owns real property located at 8101 Dublin Road, Delaware, Ohio, 43015 {Delaware County Tax Parcel 600-240-03-008-0000} which is managed by the Department of Public Utilities (“DPU”). The State of Ohio, Department of Transportation (“ODOT”) has requested a new 0.880 acre highway easement through the property in order to allow for the construction of a turn lane into the fourth water plant that the City will be building at this location. DPU and the Department of Finance and Management (“Finance”) have reviewed the easement and have no objection to the granting of the Easement at no cost. The Easement is more fully described in the three (3) page attachment to this ordinance.
This ordinance authorizes the Director of Finance, with the approval of the Director of DPU, to execute and acknowledge any necessary instrument(s), as approved by the City Attorney, in order to quitclaim grant the Easement to ODOT.
CONTRACT COMPLIANCE NO.: Not applicable.
FISCAL IMPACT: The City will not receive any compensation for the granting of this easement as the easement allows for the construction of a turn lane into the fourth water plant that the City will be building at this location.

WHEREAS, the City intends to grant The State of Ohio, Department of Transportation (i.e. “ODOT”) a highway easement burdening a 0.880 acre portion of the City’s property located at 8101 Dublin Road, Delaware, Ohio, 43015 for roadway purposes. (i.e. “Easement”); and
WHEREAS, the City intends for the Director of Finance, with the approval of the Director of the Department of Public Utilities (i.e. “DPU”) to execute and acknowledge any document(s) necessary to quitclaim grant the Easement to ODOT; and
WHEREAS, the City intends for the City Attorney to approve all instrument(s) associated with this ordinance; and
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of the Department of Finance is authorized to execute and acknowledge any document(s) necessary to quitclaim grant to the State of Ohio, Department of Transportation (i.e. “ODOT”) and ODOT’s successors and assigns, a highway easement to burden a portion of the City’s real property located at 8101 Dublin Road, Delaware, Ohio, 43015 {Delaware County Tax Parcel 319-331-01-003-00} which is managed by the Department of Public Utilities (i.e.“DPU”). This easement is for roadway purposes and is further described and depicted in the three (3) page attachment, which is fully incorporated for reference as if rewritten.
SECTION 2. That the Director of the Department of Public Utilities (i.e.“DPU”) is required to approve all documents executed by the City pursuant to this ordinance.
SECTION 3. That the City Attorney is required to approve all instrument(s) associated with this ordinance prior to the Director of Finance executing and acknowledging any of those instrument(s).
SECTION 4. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
