Explanation
 
Background: The City of Columbus owns certain real property located at 771-777 E. Long Street, commonly known as the Lincoln Theater.  The City desires to rent the ballroom and related areas of the Lincoln Theater to various businesses and private citizens in order to generate income to offset the cost of the daily operation of the facility.  Considering the expertise that the Recreation and Parks Department has in renting facilities for these purposes, it has been determined that they should manage the rental of the ballroom and certain other related areas of the theater.  Ordinance 0744-2005, passed April 27, 2005, placed this responsibility within the Department of Development.  This ordinance repeals Ord. 0744-2005.  Under this agreement, the leasing of the retail bays will continue to be managed by the Department of Development.
 
Emergency action is requested to not delay the immediate renting of certain portions of the Lincoln Theater and subsequent financial benefit to the City.
 
Fiscal Impact: Renting the facility, in accordance to a pre-determined fee structure, will provide a revenue stream for the City of Columbus to offset the operations and maintenance expenses of this City owned facility. (See Attachments)

To repeal ordinance 0744-2005, to authorize the Director of Recreation and Parks to execute those documents necessary for the short term rental agreements for the ballroom and related areas of the Lincoln Theater, and to declare an emergency.
 
Body
 
WHEREAS, the City of Columbus owns certain real property located at 771-777 E. Long Street, commonly known as the Lincoln Theater; and
 
WHEREAS, the City desires to rent the ballroom and related areas of the Lincoln Theater; and
 
WHEREAS, an emergency exists in the usual daily operation of the City of Columbus, in that it is immediately necessary to authorize the Director of Recreation and Parks to execute those documents necessary for the short term rental agreements for the ballroom and related areas of the Lincoln Theater for the immediate preservation of the public health, peace, property and safety, now, therefore:
 
                       BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.   That the Director of Recreation and Parks is hereby authorized to execute those documents as approved by the Department of Law, Real Estate Division, necessary for the short term rental agreements for the ballroom and related areas of the Lincoln Theater utilizing the fee structure attached to this legislation.
 
Section 2.  That Ordinance 0744-2005, passed April 27, 2005 be and hereby is repealed.
 
Section 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its approval
