Explanation
APPLICANT: Sarah Zinn; 100 Landers Avenue; Columbus, OH 43207.
PROPOSED USE: Type A family child care home.
FAR SOUTH COLUMBUS AREA COMMISSION RECOMMENDATION: Approval
CITY DEPARTMENTS' RECOMMENDATION: Approval. The site consists of one parcel developed with a single-unit dwelling in the SR, Suburban Residential District. The requested Council variance will allow the existing dwelling to be used as a Type A family child care home. A Council variance is required because although the SR district allows Type B family child care homes for up to seven children and day care centers in conjunction with schools or religious facilities, it does not allow a Type A family child care home. A variance to reduce required parking spaces from three to one is included in this request. The site is located within the planning boundaries of the Scioto Southland Plan (2007), which recommends “Single Family Residential (4-6 du/acre)” land uses at this location. Since the primary use of the property will remain a single-unit dwelling, Staff has no objection to the requested Type A family child care home, which must also comply with Ohio Revised Code requirements.
Title
To grant a Variance from the provisions of Sections 3332.029, SR, Suburban residential district; and 3312.49(C), Required parking, of the Columbus City Codes; for the property located at 100 LANDERS AVE. (43207), to allow a Type A family child care home with reduced parking in the SR, Suburban Residential District (Council Variance #CV26-072).
Body
WHEREAS, by application #CV26-072, the owner of property at 100 LANDERS AVE. (43207), is requesting a Council variance to allow a Type A family child care home with reduced parking in the SR, Suburban Residential District; and
WHEREAS, Section 3332.029, SR suburban residential district, only allows Type B family child care homes or child day care centers as accessory uses to a religious facility or school, while the applicant proposes to operate a Type A family child care home for a maximum of 14 children within a single-unit dwelling; and
WHEREAS, Section 3312.49(C), Required parking, requires two parking spaces for the single-unit dwelling use and one parking space per 500 square feet of child-care facility space, a total requirement of three spaces, while the applicant proposes to maintain one parking space; and
WHEREAS, the Far South Columbus Area Commission recommends approval; and
WHEREAS, the City Departments recommend approval because the request will not introduce an incompatible use to the area, and the primary use of the property will remain a single-unit dwelling; and
WHEREAS, said ordinance requires separate submission for all applicable permits and Certificate of Zoning Clearance for the proposed Type A family child care home; and
WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and
WHEREAS, the granting of said variance will not impair an adequate supply of light and air to the adjacent property, unreasonably increase the congestion of public streets, increase the danger of fires, endanger the public safety, unreasonably diminish or impair established property values within the surrounding area, or in any other respect impair the public health, safety, comfort, morals or welfare of the inhabitants of the City of Columbus; and
WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owner of the property located at 100 LANDERS AVE. (43207), in using said property as desired; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
