..Explanation
This ordinance authorizes the Public Service Director to modify and increase a design contract for the Transportation Division with Parsons Brinckerhoff Ohio, Incorporated, for the Norton Road (West Broad Street to Hall Road) project.  This is the second modification of this contract that was originally executed in 1993.  The contract includes development of an environmental document and detailed design per Ohio Department of Transportation (ODOT) standards
 
Parsons Brinckerhoff Ohio, Incorporated, (Contract compliance #13-3363319, Expiration Date October 31, 2005) was selected in accordance with Chapter 329 for professional service contracts.  This modification reflects design revisions to curb ramps, intersection details, traffic signals, rights-of-way and legal description changes, and revising plans to ODOT's specifications.
 
The consultant's overhead rate and profit were renegotiated by the Transportation Division to determine the amount of this modification.
The original contract was for $836,286.00.  The first modification was for $162,409.00 and was authorized by Ordinance 1999-2002 passed December 16, 2002.  This modification is for $80,000.00.  The total of all modifications is $242,409.00.  The total of the original contract and all modifications to date, including this one, is $1,078,695.00.
 
Fiscal Impact:  The Transportation Division budgeted $520,000 for engineering and design contracts and modifications under Roadway Improvements.  This ordinance authorizes and expenditure of $80,000.00.  
 
Emergency action is requested so that this project can proceed in an uninterrupted manner and meet completion deadlines.
 
 
 
Title
To authorize the Public Service Director to modify and increase the design contract with Parsons Brinckerhoff Ohio, Incorporated, for the Norton Road (West Broad Street to Hall Road) project for the Transportation Division; to authorize the expenditure of $80,000.00 from the 1995, 1999 Voted Streets and Highways Fund, and to declare an emergency.  ($80,000.00)
 
 
 
Body
WHEREAS, Contact CT 14903 was authorized by Ordinance 0929-1993, passed April 12, 1993, executed June 22, 1993, and approved by the City Attorney on June 28, 1993; and
 
WHEREAS, this contract was previously modified and increased by $162,409.00 as authorized by Ordinance 1999-2002, passed December 16, 2002; and
 
WHEREAS, it is necessary to modify this contract to reflect design revisions to curb ramps, intersection details, traffic signals, rights-of-way and legal description changes and revising plans to ODOT's specifications per the consultant's letter of May 25, 2004; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that the contract needs to be immediately modified and increased so that the work may proceed in an uninterrupted manner for timely completion, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Public Service be and hereby is authorized to modify and increase Contract CT 14903 with Parsons Brinckerhoff Ohio, Incorporated, 6235 Enterprise Court, Dublin, Ohio 43016 to complete the environmental document and design of construction plans for the Norton Road (West Broad Street to Hall Road) project.
 
SECTION 2.  That for the purpose of paying the cost of the contract modification, the sum of  $80,000.00, or so much thereof as may be necessary, be and hereby is authorized to be expended from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6682, OCA Code 644385 and Project 530161.
 
SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
