Explanation
Background: This ordinance authorizes the Director of Public Safety, on behalf of the Division of Fire, to modify all contracts and agreements with Phoenix Safety Outfitters LLC, which has undergone an acquisition by the Galls Family of Companies, by assigning past, present and future contracts and agreements to Fire Acquisition Company LLC dba Phoenix Safety Outfitters. The Division of Fire needs to ensure funding is available for the maintenance and repair of its FLIR Thermal Cameras, SENSIT gas detectors and monitors, and turnout gear. These services are vital for the Division of Fire to maintain health and safety standards with equipment and protective gear.
The Division of Fire previously executed three contracts in 2025 with Phoenix Safety Outfitters LLC. A contract for repair and maintenance of turnout gear for April 1, 2025 to March 31, 2026; a contract for repair and maintenance of FLIR Cameras executed for June 1, 2025 to May 31, 2026; and a contract for repair and maintenance of SENSIT gas detectors/monitors for August 1, 2025 to July 31, 2026. It was recently learned that the company had been acquired by Fire Acquisition Company LLC dba Phoenix Safety Outfitters and that the company had a new Federal Identification Number. Therefore, this Ordinance authorizes the assignment of all past, present and future business done by the Division of Fire with Phoenix Safety Outfitters LLC, FID #41-2241348 to be reassigned to Fire Acquisition Company LLC dba Phoenix Safety Outfitters, FID #39-3356641.

Remaining funds from the Division of Fire’s existing contracts purchase orders #PO512619, PO520119, and PO500042 will be utilized to establish the new contracts with Fire Acquisition Company LLC dba Phoenix Safety Outfitters after this Ordinance has passed for the corresponding maintenance and repair items.

Emergency Designation: This ordinance is being submitted as an emergency to allow for the utilization of continued maintenance and repair of the Division of Fire’s equipment, and to provide the necessary establishment of funding under the new company name and FID number to allow for the payment of services for all past, present and future business done by the Division of Fire with Fire Acquisition Company LLC dba Phoenix Safety Outfitters.

WHEREAS, the Division of Fire has a need to ensure funding is available for the maintenance and repair of the Division of Fire’s maintenance and repair of its rescue equipment and turnout gear; and
WHEREAS, the Division of Fire previously entered into a contract with Phoenix Safety Outfitters LLC for the necessary maintenance and repair of the Division of Fire’s maintenance and repair of its rescue equipment and turnout gear; and
WHEREAS, Phoenix Safety Outfitters LLC has been acquired and is now renamed as Fire Acquisition Company, LLC dba Phoenix Safety Outfitters, and in addition to notifying the City, Fire Acquisition Company, LLC dba Phoenix Safety Outfitters has agreed to honor the past, present and future contracts and agreements; and
WHEREAS, this Ordinance authorizes the assignment of all past, present and future business done by the Division of Fire with Phoenix Safety Outfitters LLC FID #41-2241348 , to be reassigned to Fire Acquisition Company LLC dba Phoenix Safety Outfitters, FID #39-3356641; and
WHEREAS, an emergency exists in the usual daily operation of the Division of Fire in that it is immediately necessary to allow for the continued use of equipment maintenance and repair services without interruption, and to provide the necessary establishment of funding under the new company name and FID number to allow for the payment of services for all past, present and future business done by the Division of Fire with MES I Acquisition Inc. dba MES Life Safety LLC, for the immediate preservation of the public health, peace, property and safety; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS;
SECTION 1. That the Director of the Department of Public Safety, on behalf of the Division of Fire be and is hereby authorized to modify all past, present and future contracts and agreements pursuant to those contracts to reflect the change of company name and FID number from Phoenix Safety Outfitters LLC FID #41-2241348, to Fire Acquisition Company LLC dba Phoenix Safety Outfitters #39-3356641.
SECTION 2. That this modification is in accordance with the pertinent provisions of Chapter 329 of the Columbus City Codes.
SECTION 3. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
SECTION 4. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 5. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is hereby declared to be an emergency measure, and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
