Title: To authorize the Director of the Public Service Department to execute those documents required to release a portion of the platted drainage easement located in Reserve "S" as delineated on the record plat titled Village at Albany Crossing, Section 2, Part 1, of record in Plat Book 106, Pages 67 and 68, of the Franklin County, Ohio Recorder's Office and to declare an emergency.

Explanation
 
The Public Service Department, Transportation Division, recently received a request asking that the City release a portion of the platted drainage easement located in Reserve "S" as delineated on the record plat titled Village at Albany Crossing, Section 2, Part 1, of record in Plat Book 106, Pages 67 and 68, of the Franklin County, Ohio Recorder's Office.  When originally platted it was intended that Reserve "S" would be used to construct two drainage basins.  Release of the requested portion of this drainage easement will not adversely impact the original plans for this area and will allow for the construction of a clubhouse facility to serve ranch condominiums being constructed to the east of this easement.  The Department of Public Utilities, Sewerage and Drainage Division, has notified this office they have no objections to the release of the requested portion of this easement.
 
Fiscal Impact:  The City will receive a total of $500.00, to be deposited in Fund 748, Project 537650, as consideration for the release of the requested portion of the platted drainage easement located in Reserve "S" of the plate titled Village at Albany Crossing, Section 2, Part 1.
 
Emergency Justification:  The release of a portion of this platted drainage easement directly affects the continued development of the Village at Albany Crossing subdivision therefore emergency action is requested.

WHEREAS, the City of Columbus, Public Service Department, Transportation Division, recently received a request asking that the City release a portion of the platted drainage easement located in Reserve "S" as delineated on the record plat titled Village at Albany Crossing Section 2, Part 1, of record in Plat Book 106, Pages 67 and 68, of the Franklin County, Ohio Recorder's Office; and
 
WHEREAS, when originally platted it was intended that Reserve "S" would be used to construct two drainage basins; and
 
WHEREAS, release of the requested portion of this drainage easement will not adversely impact the original plans for this area; and
 
WHEREAS, release of the requested portion of this drainage easement will allow for the construction of a clubhouse facility to serve ranch condominiums being constructed to the east of this easement; and
 
WHEREAS, after receipt of this request the Transportation Division verified the Department of Public Utilities, Sewerage and Drainage Division, have no objections to the release of the requested portion of this easement; and
 
WHEREAS, a value of $500.00 has been established for the release of the requested portion of this platted easement; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public service Department in that it is immediately necessary to authorize the Director to execute those documents necessary to release a portion of a platted drainage easement so that development of the Village at Albany Crossing subdivisions can proceed without delay thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Director of the Public Service Department be and is hereby authorized to execute those documents necessary to release the following described portion of a platted drainage easement located in Reserve "S" as delineated on the record plat titled Village at Albany Crossing, Section 2, Part 1, of record in Plat Book 106, Pages 67 and 68 of the Franklin County, Ohio, Recorder's Office; to-wit
 
Situated in the State of Ohio, County of Franklin, City of Columbus, lying in Section 15, Township 2, Range 16, United States Military Lands, being across the remainder of Reserve "S" of that subdivision entitled "Village at Albany Crossing, Section 2, Part 1" of record in Plat Book 106, Page 67, originally conveyed to Dominion Homes, Inc. of record in Instrument Numbers 200311040353156, 200409290226612 and 200409280225907 and described as follows:
Beginning at a corner to said subdivision and in the north right-of-way line of Warner Road and the south line of said Reserve "S", being North 03°32'10" East, 30.00 feet from a corner to said subdivision in the centerline of Warner Road;
Thence, North 86°27'43" West, with said north right-of-way line and said south line, 80.69 feet;
Thence North 48°31'38" West, across said Reserve "S", 138.13 feet to the south line of Reserve "EE" of that subdivision entitled "Village at Albany Crossing, Section 3, Part 2" of record in Plat Book 107, Page 39;
Thence with said south line, the following courses;
South 86°27'50" East, 1.64 feet to a point of curvature;
With the arc of a curve to the right, having a central angle of 06°02'18", a radius of 379.00 feet, an arc length of 39.94 feet, a chord bearing and a chord distance of South 83°26'41" East, 39.92 feet to a point of tangency;
South 80°25'32" East, 100.40 feet to a point of curvature;
With the arc of a curve to the left, having a central angle of 06°02'18", a radius of 421.00 feet, an arc length of 44.37 feet, a chord bearing and chord distance of 83°26'41" East, 44.35 feet to a point of tangency;
South 86°27'50" East, 4.00 feet to a point;
Thence South 03°32'10" West, across said Reserve "S", 69.94 feet to the Point of Beginning, containing 0.230 acre, more or less from Auditor's Parcel No. 010-275385.
Bearings are based on the Ohio State Plane Coordinate System per NAD83, 1986 adjustment.  Control for bearings was from coordinates of Franklin County Survey Control Monuments 8824 and 8825, having a calculated bearing of North 86°29'28" West, established by the Franklin County Engineering Department.
All references refer to the records of the Recorder's Office, Franklin County, Ohio.

Section 2.  That the $500.00 to be received by the City as consideration for the above referenced release shall be deposited in Fund 748, Project 537650.
 
Section 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
