Explanation
Background: This ordinance authorizes and directs the Director of the Department of Finance and Management on behalf of the Franklin County Municipal Court Clerk to establish a purchase order with Jeter Systems Corporation for the purchase of customized case file folders and storage costs. These case file folders are being acquired through a bid state term contract (GSA#GS - 28F - 1032C; State of Ohio # 774143B; Expiration 10/31/2008) that is available for the City's use. The storage costs are manifestly impractical to bid due to the Jeter Systems Corporation storing 75% of the file folder order. As a result, it is requested that the provisions of competitive bidding be waived.
The Franklin County Municipal Court Clerk utilizes case file folders to store civil, criminal, and traffic court documents and case information for the Franklin County Municipal Court, Clerk of Court.

Fiscal Impact: Funding for this purchase is available within the Franklin County Municipal Court Clerk 2008 general fund budget.
Emergency action is requested to allow the financial transaction to be posted in the City's accounting system as soon as possible. Up to date financial posting promotes accurate accounting and financial management.

Whereas, the Franklin County Municipal Court Clerk has a need to purchase customized case file folders for the storing of civil, criminal, and traffic court documents and case file information; and
Whereas, a bid state term contract GSA#GS - 28F - 1032C; State of Ohio # 774143B is available for the City's use with Jeter Systems Corporation for the purchase of customized case file folders; and
Whereas, there is a need for the Jeter Systems Corporation to store 75% of the file folders purchased, due to the lack of storage space at the Municipal Court Clerks office; and
Whereas, funding is available for this purchase within the Franklin County Municipal Court Clerk 2008 general fund budget; and
Whereas, it is in the best interest of the city to waive competitive bidding and procure the case file folders and storage costs; and
Whereas, an emergency exists in the daily operation of the Franklin County Municipal Court, Clerk of Court in that it is immediately necessary for the Director of the Department of Finance and Management to establish a purchase order with Jeter Systems Corporation, to authorize the expenditure for the purchase of customized case file folders and storage costs, thereby preserving the public health, peace, property, safety and welfare; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of the Department of Finance and Management be and hereby is authorized to establish a purchase order with Jeter Systems Corporation on behalf of the Franklin County Municipal Court Clerk for the purchase of customized case file folders through the bid state term contract GSA# GS-28F - 1032C; State of Ohio # 774143B and the purchase of storage services to store 75% of the case file folder order.
Section 2. That the expenditure sum of $89,974.85, or so much as may be needed, be and hereby is authorized within the Franklin County Municipal Court Clerk, department number 2601, general fund, fund number 010, subfund number 001, oca 260158, object level one - 02, object level two 2211 - $86,242.85; object level one 03, object level three 3336 - $3,732.00 to pay the cost thereof.
Section 3. That in accordance with 329.27 of the Columbus City Code, this Council finds the best interest of the city is served by waiving, and does hereby waive Section 329.06 (Competitive Sealed Bidding) of the Columbus City Code.
Section 4. That for reasons stated in the preamble hereto, where is hereby made a part hereof, this ordinance is hereby declared an emergency measure, which shall take effect and be in force from and after its passage and approved by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
