Explanation
 
BACKGROUND:  The Hap Cremean Water Plant (HCWP) was originally constructed in the early 1950's with periodic additions and rehabilitation to the plant since initiation.  During the initial construction asbestos containing materials were installed.  This contract provides professional engineering services for preparation of drawings and specifications for the identification and removal of asbestos from miscellaneous buildings, for the replacement of the heating system for the main treatment building at HCWP, and construction administration and inspection services.  This contract modification will provide for engineering design for changes which were implemented after evaluating energy efficiency and environmental issues which prompted a re-design for the back-up fuel system from previously utilized fuel oil to proposed new propane gas system.  These changes were not originally anticipated or included in the original project scope but were implemented after discussions with Water Treatment Plant staff and the design consultant.  Additional costs have been added for construction administration and construction inspection services do to a longer contract duration than originally anticipated, in part due to the additional construction for the back-up fuel system.

2.            The extent of additional services provided are needed due to engineering design changes which were implemented after evaluating energy efficiency and environmental issues which prompted a re-design for the back-up fuel system for the boilers.  In addition this modification will provide for additional construction administration and construction inspection services for the project, in part due to the additional construction for the back-up fuel system.
3.      The work under this contract modification is a continuation of work previously performed by the Consultant; therefore, no other processes were used for procurement of these services.
4.      The cost of this modification is based on material and labor, and was negotiated between the Consultant and the City, as documented by the Consultant's quotation letters, and verified by the Project Engineer.
 
FISCAL IMPACT:  :  The original authorization for expenditures for this project occurred October 18, 2004 in the amount of $258,905.00.  This legislation includes a transfer of funds within the Water Works Enlargement Voted 1991 Bonds Fund and an amendment to the 2007 Capital Improvements Budget.

WHEREAS, Contract No. EL-004762 was authorized by Ordinance No.1651-04,  passed October 18, 2004, was executed December 8, 2004 and approved by the City Attorney on December 10, 2004, to provide for engineering design services for the Hap Cremean Water Plant Asbestos Hazard Abatement and Heating System Replacement, and
 
WHEREAS, the original contract provided for engineering design work and engineering services for construction administration and construction inspection services, and
 
WHEREAS, this contract modification will provide for engineering design for changes which were implemented after evaluating energy efficiency and environmental issues which prompted a re-design for the back-up fuel system for the boilers, and
 
WHEREAS, this modification provides for an increase of $74,688.19 to this contract, and
 
WHEREAS, it is necessary to authorize an amendment to the 2007 Capital Improvements Budget for purposes of providing sufficient funding and spending authority for the aforementioned project expenditures; and
 
WHEREAS, it is necessary for this Council to authorize the City Auditor to transfer funds within the Water Works Enlargement Voted 1991 Bonds Fund; and
 
WHEREAS, it is necessary to authorize the Director of Public Utilities to modify Contract No EL-004762, with Dynamix Engineering Ltd. for Professional Engineering Services necessary for the Hap Cremean Water Plant Asbestos Hazard Abatement and Heating System Replacement, for the Division of Power and Water , for the preservation of the public health, peace, property, safety and welfare, Now, Therefore;
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
 
SECTION 1.  That the Director of Public Utilities be and is hereby authorized to modify Contract No EL-004762 with Dynamix Engineering Ltd. in the amount of $74,688.19 for Professional Engineering Services necessary for Hap Cremean Water Plant Asbestos Hazard Abatement and Heating System Replacement, for the Division of Power and Water , Department of Public Utilities, Project No. 690286, Contract No. 1047, terms and conditions of which are on file in the office of the Division of Power and  Water .
 
SECTION 2.  That for the purpose of paying the cost thereof, the expenditure of $74,688.19 is hereby authorized from Waterworks Enlargement Voted 1991 Bonds, Fund No. 606, Department of Public Utilities, Division of Power and  Water , Dept./Division No. 60-09, Object Level Three 6682, Project No. 690286, OCA Code 642900.
 
SECTION 3.  The City Auditor is hereby authorized and directed to transfer funds from within the Waterworks Enlargement Voted 1991 Bonds Fund, Fund No. 606, Department of Public Utilities, Division of Power and Water, as follows:

SECTION 5.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
SECTION 6.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
SECTION 7.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.
 
SECTION 8.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
