BACKGROUND: This ordinance authorizes the Director of the Department of Development to enter into a development agreement with Community Housing Partnership for street and infrastructure improvements in the public right of way as part of the Columbus Housing Initiatives Project, Capital Improvement Program. Community Housing Partnership is constructing seven affordable homes. The project is located in the Columbus Public School District and located in an area south of Main Street, north of Livingston Avenue and east of James Road.
 
Emergency action is requested so that development agreement can be in place during the construction season.
 
FISCAL IMPACT:  Funds for this project are located in the 2005 capital improvements budget.

Body
 
WHEREAS, the Director of the Department of Development desires to enter into a development agreement with Community Housing Partnership for street and infrastructure improvements in the public right of way; and
 
WHEREAS, the project is located in the Columbus Public School District and located in an area south of Main Street, north of Livingston Avenue and east of James Road; and
 
WHEREAS, Article I. Chapter 901.01 of the Code of the City of Columbus, Ohio 1959, authorizes the Director of the Department of Development to enter into an agreement providing for such improvements; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Development, in that it is immediately necessary to enter into a development agreement with Community Housing Partnership for infrastructure construction reimbursement as part of the Columbus Housing Initiatives Project Capital Improvement Program so that development agreements can be in place during the construction season, thereby preserving the public health, peace, property, safety and welfare; and, NOW, THEREFORE,
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
Section 1.      That the Director of the Department of Development be and is hereby authorized to enter into a development agreement with Community Housing Partnership for the period of March 1, 2006 to February, 28, 2007, to expend $126,000 or so much thereof as necessary for the reimbursement of costs of constructing infrastructure improvements for 7 homes.
 
Section 2.      That this development agreement is a guaranteed fixed price contract whose total amount shall not exceed $126,000.00 pursuant to City Charter, Section 186.
 
Section 3.      That the sum of $126,000.00, or so much thereof as may be necessary, be and is hereby authorized to be expended from Fund 704, Voted 1995, Voted 1999 Streets and Highway Fund, Transportation Division, Department No. 59-03, Object Level One 06, Object Level Three 6631, OCA Code 644385 and Project No. 530303.
 
Section 4.      That for the reasons stated in the preamble thereto, which is hereby made a part hereof, this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
