PROPOSED USE:  Tire Service Facility
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (6-0) on July 12, 2007.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The site is located in an area of mixed uses, with non-residential uses to the north and east as well as the applicant's existing tire shop to the west and other commercial uses.  Single-family dwellings are located across the alley to the east.  The proposed L-M, Limited Manufacturing District is compatible with the adjacent single-family dwellings due to the orientation of the bay doors to the north away from the residences.  Furthermore, the use limitations and buffering provisions in the text help ensure compatibility with the residences to the east.

WHEREAS, application #Z07-023 is on file with the Building Services Division of the Department of Development requesting rezoning of 0.40± acres from R, Rural District, to L-M, Limited Manufacturing District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the site is located in an are of mixed uses, with non-residential uses to the north and east as well as the applicant's existing tire shop to the west and other commercial uses.  Single-family dwellings are located across the alley to the east.  The proposed L-M, Limited Manufacturing District is compatible with the adjacent single-family dwellings due to the orientation of the bay doors to the north away from the residences.  Furthermore, the use limitations and buffering provisions in the text help ensure compatibility with the residences to the east.  , now, therefore:    
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
 
1887 SOUTH THIRD STREET (43207), being 0.40± acres located on the west side of South Third Street, at the northwest and south west corners of South Third Street and Hinkle Avenue, being more particularly described as follows:
 
Legal Description of 0.445 Acres of Land for Zoning Purposes.
Situated in the State of Ohio, County of Franklin, City of Columbus, and being 0.445 acres of land and said 0.445 acre tract being all of Lot 4, Lot 5, and Lot 6 of Rachel F. Lyon's Subdivision of record in Plat Book 4 page 195, at the Franklin County Recorders Office, Franklin County, Ohio, and said Lots belonging to LE PNEU Inc., of record in Instrument No. 200011030223725 at said Recorders Office, and said 0.445 acre tract also being all of Lot 8 of Chambers Addition of Record In Plat Book 4 page 325, at said Recorders Office, and said Lot 8 also belonging to LE PNEU Inc., of record in Official Record 16454 F11 at said Recorders Office, and said 0.445 acre tract also being part of Hinkle Avenue (12 feet wide), and said 0.445 acre tract of land being more particularly described as follows:
Beginning at a point, said point being located at the most southwesterly corner of said Lot 6, said point also being located at the easterly right-of-way line of Pearl Street (18 feet wide), thence along the easterly right-of-way line of said Pearl Street and the westerly boundaries of said Lots 4, 5, 6, 8, and also across said Hinkle Avenue, N 06° 30' 00" E, a distance of 138.60 feet to a point, said point being located at the most northwesterly corner of said Lot 8;
Thence along the northerly boundary of said Lot 8, S 83° 30' 00" E, a distance of 140.00 feet to a point, said point being located at the most northeasterly property corner of said Lot 8, said point also being located at the westerly right-of-way line of Third street (40 feet wide);
Thence along the said westerly right-of-way line and also along the easterly boundaries of said Lots 4, 5, ,6, 8, and also across said Hinkle Avenue, S 06° 30' 00" W, a distance of 138.60 feet to a point, said point being located at the most southeasterly corner of said Lot 6;

SECTION 2.  That a Height District of thirty-five (35) feet is hereby established on the L-M, Limited Manufacturing District on this property.
 
SECTION 3.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division and shall register a copy of the approved  L-M, Limited Manufacturing District and Application among the records of the Building Services Division as required by Section 3370.03 of the Columbus City Codes; said text being titled,  "LIMITATION TEXT", signed by Ronald Beach, Applicant, dated  August 24, 2007, and reading as follows:

1. INTRODUCTION:      The subject property consists of four parcels totaling approximately .445 acres. All of the property is annexed into the City of Columbus and all parcels are currently zoned R. To the West of the subject site is zoned M and operated by Shope's Tire Service which is affiliated with the Applicant. To the North, East and South the properties are zoned R. To the South is undeveloped land similar to the applicants. It is zoned R, however, it is owned by a Corporation and we believe intended for commercial use of some type.
   
2. PERMITTED AND PROHIBITED USES:  
 
a)      All M uses are prohibited except Warehouse or storage in bulk for: Clothing, Cotton, Drugs, Drygoods, Feed, Food, Furniture, Hardware, Ice, Machinery, Metals, Paint, Paint materials, Pipe, Rubber, Shop Supplies, Soil Stabilizer, Tobacco, Wool; Wholesaling or distributing establishment or warehouse or wholesale market.
b)      All C5 uses are prohibited except Auto service stations without gasoline sales.
c)      All C4 uses are prohibited except Automotive Accessories, Parts and Tire Stores.
d)      All C3 uses are prohibited.
e)      All C2 uses are permitted except Banks with a pick up unit.
f)      All C1 uses are permitted.
 
3. DEVELOPMENT STANDARDS:
 
A. Building Orientation and Access Commitments.
 
1.      Overhead bay doors, loading docks or garage doors shall be oriented toward the north property line.
 
2.       Any new buildings shall be oriented more toward High Street and the existing M zoned buildings than toward Third Street where there are residential structures.
 
B. Screening Commitments.
 
1.      A six-foot board on board fence shall be installed along the East property line. Deciduous trees with a minimum caliper of 2 ½" shall be planted, evenly spaced, at a ratio of one tree per twenty lineal feet on the inside of the fence.
 
C. Lighting Commitments.
 
1.      Light standards shall not exceed 28 feet in height except lights located within 100 feet of a residentially used or zoned property shall not exceed 18 feet in height.
2.      Lights shall have fully shielded, recessed lamps directed downward to prevent glare and shine above the horizontal plane.
3.      For aesthetic compatibility, lights shall be from the same or similar type and color.
4.      Lighting shall not exceed .1 foot-candle along the property line of a residentially used or zoned property.
 
D. Graphics and/or Signage Commitments.
 
1.      All graphics and signage shall comply with the Graphics Code, Article 15, Title 33 of the Columbus City Code and any variance to those requirements will be submitted to the Columbus Graphics Commission for consideration.
 
Section 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
