Explanation
This legislation authorizes a contract modification with Columbus Engineering Consultants, Incorporated, for design of the Third Street bridges over Nationwide Boulevard and Goodale Street that is necessary but was not included in the original contract (EA 026020-002). The Ohio Department of Transportation (ODOT) is paying for the construction of this project. The original intent was to coordinate the construction with the Third Street over I-670 bridgework that occurred as part of the Spring Sandusky Interchange improvement. After the project was awarded and the consultant began work, ODOT pushed back the funding for the Third Street bridges to state fiscal year 2007. During the evaluation of the bridge the consultant recommended that pier number 6 and a strip seal joint were in need of repair. Rainwater has poured through the nonfunctional finger joint over pier number 6 and caused progressive deterioration. The replacement joint device has also deteriorated and should be changed to a strip seal expansion joint on the Ohio Center Way ramp; this may loosen and fall off if not repaired. The consultant also needs to modify the maintenance of traffic plan that was originally submitted due to the change in ODOT funding. There has also been some direct cost increase due to long delays in the project.
This contract was originally authorized in the amount of $348,698.00 by Ordinance 1757-2000, passed by City Council on July 17, 2000. The proposed design modification cost totals $113,075.00. This is the first modification. The contract cost with the modification is $461,773.00.
Columbus Engineering Consultant's contract compliance number is 31-0716498 and expires April 9, 2005.
Fiscal Impact: The Transportation Division budgeted $120,000 for the contract modification for the Third Street Bridge over Goodale Street under the project Federal/State Match.
Emergency action is requested so that the consultant may continue working on this project and meet the current ODOT schedule; these structural matters must be addressed to avoid devastating effects to the motoring public.

To authorize the Public Service Director to modify and increase the existing contract with Columbus Engineering Consultants, Incorporated, for design of the Third Street bridges over Nationwide Boulevard and Goodale Street for the Transportation Division; to authorize the expenditure of $113,075.00 from the 1995, 1999 Voted Streets and Highways Fund, and to declare an emergency. WHEREAS, a $348,698.00 design contract for design of the Third Street bridges over Nationwide Boulevard and Goodale Street was originally entered with Columbus Engineering Consultants, Incorporated, as authorized by Ordinance 1757-2000 passed by City Council July 17, 2000, and
WHEREAS, additional work is necessary to complete the design of the rehabilitation of the Third Street Bridge over Goodale Street; and
WHEREAS, funds for this purpose have been budgeted and are available with the summer 2004 bond sale; and
WHEREAS, an emergency exists in the usual daily operation of the Transportation Division, Public Service Department, in that it is immediately necessary to modify and increase this design contract in order expedite completion of the design and ultimately to avoid devastating effects to the motoring public; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Public Service Director be and hereby is authorized to modify and increase an existing design contract (EA 026020-002) with Columbus Engineering Consultants, Incorporated, 840 Michigan Avenue, Columbus, Ohio 43215 for additional work that is necessary to complete the design of the rehabilitation of the Third Street Bridge over Goodale Street for the Transportation Division.
SECTION 2. That the expenditure of $113,085.00, or so much thereof as may be necessary, be and hereby is authorized from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6682, OCA Code 644385 and Project 530208 for this purpose.
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
