Explanation

BACKGROUND:  In 1994, The Department of Public Utilities initiated a contract (CT-15918) for software and services related to water and sewer information management system (WASIMS).  The original contract, Section 12, provided for modifications and changes in scope of service.  However, during fiscal year 2000, the original contract was assumed by the Department of Technology along with the operations and maintenance responsibilities; with the modifications and services provided by Indus Utility Systems, Inc. (Indus); now known as Ventyx, Inc; this name change was previously addressed in ordinance number 0649-2007.  

 

This legislation authorizes the Department of Technology (DoT) on behalf of the Department of Public Utilities to modify an annual renewal contract with Ventyx Inc., formerly known as Indus Utility Systems, Inc. (Indus).  This contract will allow the Department of Technology to continue services that provide upgrades, new releases and computer programming software maintenance on the water and sewer information management system (WASIMS) and for the Advantage, Customer Suite and Service Suite software and other related support services; utilizing the terms and conditions in accordance with the original contract.  Also, this contract will make provisions for ongoing support of modifications made to the base system at the request of the Department of Public Utilities, Division of Water, and assures that modifications are compatible with any new release of the billing system software or that Ventyx will expend the necessary effort to deliver those modifications in the new release.  The coverage period for the services related to this modification is for twelve months commencing October 2006 through September 2007.  This fee is a payment that is and has been paid in the arrears as in the terms of the original contract.

 

 

FISCAL IMPACT: Thus far this year, The Department of Technology has written legislation, Ordinance # 0674-2007, to approve the expenditure of $307,611.00 for annual renewal of services provided by Ventyx.  Also, for the WASIMS Banner upgrade project, ordinance #0649-2007 passed City Council on June 4, 2007, in the amount of $577,000, with Ventyx; utilizing the Department of Public Utilities' Capital funds.  Prior to the passage of these two ordinances, the Department of Technology, on behalf of the Department of Public Utilities encumbered an aggregate total of $2,380,536.10 with Indus for software license, support, upgrades, maintenance and related services.  The expenditure, in the amount of $223,599.00 for the software licenses, upgrades and related services, are available in the Department of Technology's information services fund.  Approval of this ordinance will bring the contract aggregate total to $3,488,746.10.

 EMERGENCY: Emergency designation is being requested to immediately facilitate prompt payment; to continue with services that are necessary to support daily operation activities; to ensure no service interruption.

Body

WHEREAS, Indus Utility Systems, Inc. (Indus) and the Department of Public Utilities executed contract CT-15918 in 1994 under Ordinance 1996-94 for Technical Agreement (TCP Agreement) and Technical Currency Support Services, and

 

WHEREAS, the city needs Indus to maintain existing software with all current upgrades and revisions under the Advantage, Customer Suite and Service Suite and other related  support services portion of this contract with payment coverage period from 10/1/06 to 9/30/07, and

 

WHEREAS, without the agreement, the Division of Water will not receive upgrades and the capability to debug the system, negatively impacting the water and sewer billing system, and

 

WHEREAS, an emergency exist in the usual operation of the Department of Technology, in that it is necessary to modify a contract, on behalf of the Department of Public Utilities, with Ventyx Inc. (formerly known as Indus Utility Systems, Inc) to continue software maintenance and related services on the water and sewer information management system (WASIMS) for the preservation of the public health, peace, property, safety and welfare; now, therefore                                       

 

 

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

 

SECTION 1: That the Director of the Department of Technology, on behalf of the Department of Public Utilities, be and is hereby authorized to modify a contract with Ventyx Inc. for software maintenance and related services, for the water and sewer information management system (WASIMS).

 

SECTION 2: That the expenditure of $223,599.00 or so much thereof as may be necessary is hereby authorized to be expended from:
