Explanation
 
Background:
The Historic Resources Commission is charged with identifying structures of historic and architectural significance, maintaining a list of these structures and other historic resources, and providing regulations through design review.  With these goals in mind, the Columbus Register of Historic Properties was created.
 
An application has been made by Carole Tomko (owner) to list the Richard Berry Jr. House, 324 East North Broadway in the Columbus Register of Historic Properties.  Proper notice was given as required by Chapter 3117, C.C., and a public hearing was held on June 16, 2005.  Based on the historic and architectural information provided in the nomination, the Historic Resources Commission recommended that the Richard Berry Jr. House be listed in the Columbus Register of Historic Properties.
 
The Richard Berry Jr. House is being nominated to the Columbus Register of Historic Properties under Criterion C, for its association with architect Roy Simms, an original member of the architectural firm now known as Schooley Caldwell; and Criterion D, for craftsmanship and Colonial Revival style design.
 
 
Fiscal Impact: No funding is required for this legislation.
 
 
 
Title
 
To designate the Richard Berry Jr. House, 324 East North Broadway, as an Individually Listed Property on the Columbus Register of Historic Properties.
 
 
 
 
Body
 
WHEREAS, the Historic Resources Commission is charged, in part, with identifying structures of historic and architectural significance, maintaining a list of these structures and other historic resources, and providing regulations through design review; and
 
     WHEREAS, the Historic Resources Commission maintains a roster of Listed Properties entitled the Columbus Register of Historic Properties; and
 
     WHEREAS, in compliance with C.C. 3117.04 (B), a duly authenticated nomination for listing the Richard Berry Jr. House, 324 East North Broadway, in the Columbus Register of Historic Properties was filed with the Historic Resources Commission; and
 
     WHEREAS, in accordance with C.C. 3117.061 (A) (1) and (B) proper notice was given; and
 
WHEREAS, a public hearing was held on June 16, 2005 at which time the Historic Resources Commission reviewed the nomination to determine whether the Richard Berry Jr. House, 324 East North Broadway, is qualified for listing in the Columbus Register of Historic Properties under Criteria C, & D of C.C. 3117.05; and
      
WHEREAS, the standards for Criterion C state, "the property is identified as a significant work of an architect, artisan, engineer, landscape architect, or builder whose individual work has influenced the historical, architectural, or cultural development of the city, state, or nation"; and
 
WHEREAS, the standards for Criterion D state, "the property demonstrates significant craftsmanship in architectural design, detail, or use of materials"; and
 
     WHEREAS, the Historic Resources Commission has determined that the Richard Berry Jr. House, 324 East North Broadway, is qualified for listing in the Columbus Register of Historic Properties under Criteria C, & D of C.C. 3117.05 and therefore recommends approval of the nomination to Columbus City Council ; now, therefore,
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
Section 1.             That Council finds that all pertinent terms of Chapter 3117, Columbus City Codes, 1959,
have been met for the nomination of the Richard Berry Jr. House, 324 East North Broadway,
including those as to notice and designation criteria, and that the property should be listed in the
Columbus Register of Historic Properties.
 
Section 2.      That the Historic Resources Commission is hereby authorized and directed to enter the Richard Berry Jr. House, 324 East North Broadway, in the Columbus Register of Historic Properties as an Individually Listed Property, no. 44 (CR-58.)
 
Section 3.      That the City Clerk is directed to certify a copy hereof to the City Historic Preservation Officer.
 
Section 4.      That the Historic Preservation Officer shall have said designation recorded in the official records
of the Franklin County Recorder.
 
Section 5.      That this ordinance shall take effect and be in force from and after the earliest period allowed by
law.
