BACKGROUND:  
This ordinance authorizes the Director of the Department of Technology to enter into a contract with Software House International (SHI), for annual subscription and support of IBM Rational software.  DoT uses IBM Rational software to manage its technology application development, enabling the Applications Section to deliver high quality support to its city department customers, utilizing industry best practices in business process development.
 
DoT purchased IBM Rational license subscriptions by authority of ordinance 1259-2009, passed November 9, 2009 (purchase order FL004485).  A contract (FP019146) for software subscription renewals and support for term period January 1, 2011 to June 30, 2011 was awarded to SHI as the result of an Invitation to Bid (SA003685). This year another Invitation to Bid (SA003920) received three (3) responses for annual subscription renewals and support for term period July 1, 2011 to June 30, 2012.  Upon completion of reviewing the bids, the award was made to the lowest, responsive and responsible bidder, SHI, offering the needed services at a cost of $32,443.00.  This agreement will enable the DoT to receive the latest versions of IBM Rational software and access IBM technical support.

EMERGENCY:  Emergency action is requested to expedite authorization of this contract in order to facilitate and maintain uninterrupted services from the supplier.
 
FISCAL IMPACT:  The funds for this purchase in the amount of $32,443.00 are budgeted and available within the Department of Technology, Information Services Division, Internal Services Fund.

WHEREAS, this legislation authorizes the Director of the Department of Technology to enter into a contract with Software House International (SHI) for annual subscription and support of IBM Rational software, which enables the DoT to receive the latest versions of IBM Rational software and access IBM technical support, and
 
WHEREAS, the Department of Technology received three (3) bid responses for solicitation SA003920, for subscription renewal and support for term period July 1, 2011 through June 30, 2012, and the lowest, responsive and responsible bidder was SHI, at a cost of $32,443.00, and
 
WHEREAS, the prior year award (SA003685) was also awarded to SHI through an invitation to bid, with a term period of January 1, 2011 through June 30, 2011, and
 
WHEREAS, an emergency exist in the daily operation of the Department of Technology in that it is immediately necessary for the Director of Department of Technology to enter into a contract with SHI for subscription support of the IBM Rational software, as not to impact the daily operation of the services provided; thereby preserving the public health, peace, property, safety, and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1: That the Director of the Department of Technology is hereby authorized to enter into a contract with Software House International (SHI), for IBM Rational software support, in the amount of $32,443.00, with a term period of July 1, 2011 through June 30, 2012.
 
SECTION 2: That the expenditure of $32,433.00 or so much thereof as may be necessary is hereby authorized to be expended from:

SECTION 3: That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 4: That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
