Explanation
 
BACKGROUND:  This ordinance authorizes the Public Utilities Director to enter into a planned  modification and increase of a professional engineering services contract, with R.D. Zande & Associates, Inc., for construction administration services for the Taylor Road 2MG Water Storage Tank project.  Formal bids for the construction of this tank are scheduled to open February 21, 2007.  Construction Administration services will begin at the start of construction.
1.      Amount of additional funds to be expended:  $83,500.00
     Original Contract Amount:  $93,000.00
      Amount of original contract and this modification:  $176,500.00
 
2.      Reasons additional goods/services could not be foreseen:   
Construction administration was foreseen and included and evaluated as part of the original scope of the project and proposal.
 
3.      Reason other procurement processes are not used:  
Since R.D. Zande & Associates, Inc. prepared the plans and specifications for this water storage tank, it would not be feasible to contract with another company, as they would already be familiar with the project and could therefore provide excellent service on the requested task.  Additionally, Ordinance Number 1372-2005 specifically stated R.D. Zande & Associates, Inc. would be requested for construction administration services.
 
4.      How cost of modification was determined:  
The consultant originally quoted $72,000.00 for these services, but this estimate was given before the tank was designed.  Additionally, pricing was based on 2005 dollar figures.

FISCAL IMPACT:  There is sufficient funding in the Water Works Enlargement Voted 1991 Bonds Fund.

WHEREAS, Contract No. EL005926 was authorized by Ordinance No. 1372-2005, passed September 26, 2005, was executed on April 5, 2006, and was approved by the City Attorney on April 13, 2006; and
 
WHEREAS, Ordinance Number 1372-2005 specified the contract would be modified to include construction administration services with R.D. Zande & Associates, Inc.; and
 
WHEREAS, it has become necessary in the usual daily operation of the Department of Utilities, Division of Power and Water, to modify and increase the existing contract with R.D. Zande & Associates, Inc., for construction administration services for the Taylor Road 2MG Water Storage Tank project, for the preservation of the public health, peace, property, safety and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Public Utilities Director is hereby authorized and directed to enter into a planned modification of an existing professional engineering services contract, with R.D. Zande & Associates, Inc., for construction administration services for the Taylor Road 2MG Water Storage Tank project, in the amount of $83,500.00.
SECTION 2.  That this contract modification is in compliance with Section 329.16 of Columbus City Codes, 1959.
 
SECTION 3.  That to pay the cost of the aforesaid contract modification, the expenditure of $83,500.00, or so much thereof as may be needed, is hereby authorized from the Water Works Enlargement Voted 1991 Bonds Fund, Fund No. 606, Division No. 60-09, Project Number 690426, OCA Code 606426, Object Level Three 6621.
 
SECTION 4.  That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
