Explanation

 

BACKGROUND:

This ordinance approves the acceptance of certain territory (AN24-006) by the city of Columbus. The Ohio Revised Code stipulates that to be effective, City acceptance must take place a minimum of 60 days from the receipt by the City Clerk of the approval notice from the county. If City Council does not accept the ordinance within 120 days of its first consideration, the annexation will be considered rejected. This petition was filed with Franklin County on June 18, 2024. City Council approved a service ordinance addressing the site on June 24, 2024. Franklin County approved the annexation on July 30, 2024 and the City Clerk received notice on August 12, 2024.

FISCAL IMPACT:

Provision of municipal services does represent cost to the City; however, the annexation of land also has the potential to create revenue to the City.

To accept the application (AN24-006) of Adterra Development LLC for the annexation of certain territory containing 12.4± acres in Franklin Township.

Body

 

WHEREAS, a petition for the annexation of certain territory in Franklin Township was filed on behalf of Adterra Development LLC on June 18, 2024; and

WHEREAS, the petition was considered and approved by the Franklin County Board of Commissioners at a hearing on July 30, 2024; and

WHEREAS, on August 12, 2024, the City Clerk received from Franklin County a certified copy of the resolution addressing the petition; and

WHEREAS, sixty days have now elapsed since receipt of the resolution in accordance with the provisions of the Ohio Revised Code; and

WHEREAS, it is in the best interest of the city of Columbus to accept the annexation of the territory addressed by the petition; now, therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS

SECTION 1. That the annexation proposed by Adterra Development LLC in a petition filed with the Franklin County Board of Commissioners on June 18, 2024 and subsequently approved by the Board on July 30, 2024 is hereby accepted and said territory is hereby annexed to the city of Columbus. Said territory is described as follows:

Situate in the State of Ohio, County of Franklin, Township of Franklin, being in Virginia Military Survey Number 530, being part of a 2.653 acre tract of land as conveyed to Adterra Development, LLC in Instrument Number 202205130073541 and being part of a 10 acre tract of land as conveyed to Adterra Development, LLC in Instrument Number 202205130073547, all records being of the Recorder's Office, Franklin County, Ohio, and being more particularly bounded and described as follows:

BEGINNING at the easterly corner of said 10 acre tract, also being a northerly corner of a 1. 738 acre tract as conveyed to Wendy Anne McCrady in Instrument Number 201609120122484, also being a westerly corner of a 25.816 acre tract as conveyed to Adterra Development, LLC in Instrument Number 202205130073540, being on the existing City of Columbus Corporation line, as shown in Case Number COC #260, Ordinance Number 1331-68, and recorded in Miscellaneous Record 146, Page 146;

Thence along the southeasterly line of said 10 acre tract, along the northwesterly lines of said 1.738 acre tract, a 1.216 acre tract of land as conveyed to LESLIE E. JOHNSON and GREGORY R. JOHNSON in Instrument Number 200104240086940, and a 2.45 acre tract of land as conveyed to Matthew T. Schirtzinger and Lisa M. Schirtzinger in Instrument Number 200409100212568, South 65°48'35" West, 1219.5± feet to the northeasterly line of Hague Avenue (width varies) and a highway easement conveyed to the County of Franklin of record in Deed Book 1137, Page 550;

Thence along the northeasterly line of said Hague Avenue and said easement, across said 10 acre tract and said 2.653 acre tract, North 23°51 '52" West, 449.2± to the northwesterly line of said 2.653 acre tract, also being on the southeasterly line of a 0.634 acre tract of land as conveyed to ROBERT M.THOMPSON and SHARON K. THOMPSON in Instrument Number 200510240223661;

Thence along the northwesterly line of said 2.653 acre tract, along the southeasterly lines of said 0.634 acre tract and a 4.587 acre tract of land as conveyed to Michael Rhett in Instrument Number 201608160107778, North 66°13'35" East, 1213.0± feet to the northerly corner of said 2.653 acre tract and the easterly corner of said 4.587 acre tract, being on the westerly line of said City of Columbus Corporation line;

Thence along said City of Columbus Corporation line, along the northeasterly lines of said 2.653 acre tract and said 10 acre tract, along the southwesterly line of said 25.816 acre tract, South 24°42'52" East, 440.4± feet to the POINT OF BEGINNING, containing 12.4 acres, more or less in the proposed annexation.

The total acreage of the combined boundary described herein contains a net acreage of 12.4 acres, being 2.6 acres out of PID 140-000549 and being 2.6 acres out of PID 140-003581.

This description and exhibit are intended for annexation purposes only and is not to be used for transfer of property.

The total perimeter of annexation is 3322.1 ± feet, of which 440.4± feet is contiguous with the City of Columbus by Case Number COC #260 (Ordinance Number 1331-68, City of Columbus), giving 13.3% border continuity.

SECTION 2. That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.

SECTION 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
