Explanation
BACKGROUND:
This legislation authorizes the Director of the Department of Technology (DoT) to renew a contract with Becker Software for annual software maintenance and support services for the Facil software program used by Media Services, to manage Columbus Television (CTV) programming and resources. The original contract, associated with purchase order ED011649, was established in 2003. The contract was renewed by authority of ordinance 1411-2010, passed October 25, 2010 with support through October 17, 2011. This ordinance will renew support for term period October 18, 2011 through October 17, 2012 in the amount of $250.00.
This ordinance also requests approval to continue services provided by Becker Software in accordance with the sole source provisions of Section 329 of the Columbus City Code; as it has been determined Becker Software is the sole distributor of Facil software and does not utilize distributors or resellers to provide maintenance and support for its software products.
FISCAL IMPACT: In 2010 the Department of Technology expended $250.00 with Becker Software for software maintenance and support services. This request for the same services in the amount of $250.00 has been budgeted and identified within the Department of Technology 2011 Internal Services Fund. The contract aggregate total including this request is $1,500.00.
EMERGENCY: Emergency legislation is requested in order to avoid interruption of service provided for Media Services.

Body
WHEREAS, the Department of Technology Media Services has a need to renew an annual software maintenance and support services contract with Becker Software for Facil software associated with the city's CTV operation, to manage media and resource programming, and
WHEREAS, the City of Columbus, Department of Technology entered into a support services contract, associated with ED011649, provided by Becker Software, in July 2003, and
WHEREAS, the passage of this ordinance will allow the Department of Technology to renew a contract with Becker Software with a coverage period from October 18, 2011 through October 17, 2012 in the amount of $250.00, and
WHEREAS, this contract is being established in accordance with the sole source provisions of the Columbus City Code, Section 329.07, and
WHEREAS, an emergency exists in the usual and daily operation of the Department of Technology in that it is immediately necessary for the Director of DoT to renew an annual contract for software maintenance and support services with Becker Software to support the Facil software program and the daily operation activities, thereby preserving the public health, peace, property, safety, and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1: That the Director of the Department of Technology be and is hereby authorized to renew an annual software maintenance and support services contract with Becker Software, for Facil software which supports Media Services Columbus Television (CTV) operation. This contract provides support from October 18, 2011 through October 17, 2012, in the amount of $250.00.
SECTION 2: That the expenditure of $250.00 or so much thereof as may be necessary is hereby authorized to be expended from:

SECTION 3: That the City Auditor is authorized to make any changes to revise the funding source for any contract or contract modifications associated with this ordinance.
SECTION 4: That this contract is being established in accordance with the sole source provisions of the Columbus City Code, Section 329.07.
SECTION 5: That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
