Explanation
 
BACKGROUND:  This legislation is needed to enter into a Memorandum of Understanding (MOU) with the Franklin County Sheriffs Office (FCSO) to participate in a Child Sexual Predator Program (CSPP) Grant program.  The Child Sexual Predator Program is a federal grant program through the Community Oriented Policing Services (COPS) office to reduce and prevent child endangerment and protect communities from sexual predators.  As part of the collaboration with FCSO, the City of Columbus Police Division (CPD) will receive reimbursement for training and travel costs for a Child Sexual Predator Program Kick-Off Conference and additional CSPP related training expenditures.  CPD will also receive partial reimbursement for overtime worked for program activities to locate, arrest, and prosecute child sexual predators.  The FCSO will purchase grant funded computer related equipment and software to assist in preventing and prosecuting internet crimes against children.  FCSO will transfer some of this grant funded equipment to CPD.  CPD will be responsible for the storage, maintenance, use and repair, if applicable, of the equipment (expected approximate value - $37,695.00).  The MOU period is January 1, 2009 through August 31, 2010 and therefore, there is a need to enter into the MOU and appropriate the available grant funds at the earliest possible time.  
 
EMERGENCY DESIGNATION:  Emergency legislation is necessary to enter into the Memorandum of Understanding and appropriate grant funding, as the grant period has already commenced.
 
FISCAL IMPACT:  This ordinance authorizes the appropriation of $108,320.00 in the General Government Grant Fund for a Memorandum of Understanding to reduce and prevent child endangerment and protect the community from sexual predators.  All funds appropriated are reimbursable through the Child Sexual Predator Program Grant via the Franklin County Sheriff's Office.  The General Fund will be required to pay an estimated $26,760.00, the cost of non-reimbursable fringe benefits.

WHEREAS,  the Franklin County Sheriff's Office has been awarded a Child Sexual Predator Program Grant that will fund sworn overtime, training costs, and the purchases of computer related equipment and software for use in locating, arresting, and prosecuting child sexual predators; and
 
WHEREAS,  the City of Columbus Police Department will collaborate with the Franklin County Sheriff's Office on the Child Sexual Predator Program Grant activities; and
 
WHEREAS, the Franklin County Sheriff's Office will provide grant funded reimbursement to the Columbus Police Department for partial overtime costs and specialized grant training expenditures and will transfer grant funded equipment to the Columbus Police Department; and
 
WHEREAS,  a Memorandum of Understanding between the Franklin County Sheriff's Office and the City of Columbus Police Department is needed to establish the terms and conditions for the Child Sexual Predator Program Grant collaboration; and
 
WHEREAS, an appropriation is needed to cover the costs associated with the Child Sexual Predator Program Grant activities; and
 
WHEREAS, this ordinance is being submitted as an emergency measure because the MOU period is January 1, 2009 through August 31, 2010 and funds need to be made available at the earliest possible time; and
 
WHEREAS,  an emergency exists in the usual daily operation of the Division of Police, Department of Public Safety, in that it is immediately necessary to enter into the aforementioned MOU for the Child Sexual Predator Program Grant and to appropriate $108,320.00 for the grant activities costs, thereby preserving the public peace, property, health, safety and welfare; now therefore  
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.      That the Director of Public Safety is hereby authorized and directed to enter into a Memorandum of Understanding (MOU) with the Franklin County Sheriff's Office covering the reimbursement of partial overtime costs, specialized grant training expenditures and the receipt of grant funded equipment through the Child Sexual Predator Program.
 
SECTION 2.      That from the unappropriated monies in the General Government Grant Fund and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the MOU period the sum of $108,320.00 is appropriated as follows:

SECTION 3.      That the monies appropriated in the foregoing Section 2 shall be paid upon order of the Director of Public Safety; and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.
 
SECTION 4.      That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
