Explanation
 
BACKGROUND: This legislation authorizes the City Auditor to make payment to Patricia VanDyke for vacation time which has been accumulated in excess of the maximum amount established by the Management Compensation Plan. Ms. Van Dyke has been unable to take vacation due to the vacancy of the position of Deputy City Treasurer in the City Treasurer's Office.
Emergency Action is requested to facilitate prompt payment for the unused vacation leave.
FISCAL IMP ACT: There is sufficient appropriation authority within the 2006 budget to fund this ordinance.

Body
 
WHEREAS, Section 12(C) of the Management Compensation Plan provides for payment of accrued vacation balances in excess of the maximums fixed the Plan; and
WHEREAS, Patricia VanDyke, Administrative Analyst II, will have 80.00 hours of excess vacation at the end of the vacation year; and
WHEREAS, it is not in the best interest of the City to have Patricia VanDyke take the vacation leave which would otherwise be forfeited; and
WHEREAS, an emergency exists in the usual daily operation of the City Treasurer's Office, in that it is immediately necessary to make payment to Patricia VanDyke for vacation time and benefits which have been accumulated in excess of the maximum amount established by the Management Compensation Plan in order to preserve the public health, peace, property, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the City Auditor be and hereby is authorized and directed to make payment to Patricia VanDyke for a vacation balance in excess of the maximum fixed by Section 12 (C) of the Management Compensation Plan and the associated retirement and workers compensation contributions.
SECTION 2. That the expenditure of $2,304.00, or so much thereof that maybe necessary in regard to the action authorized in SECTION 1, be and is hereby authorized and approved as follows:

SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
