Explanation
Background: The City of Columbus, Ohio, holds title to a certain easement, located in the vicinity of Goodale Boulevard and Poplar Avenue, by virtue of Miscellaneous Records Vol. 14, Page 621, Recorder's Office, Franklin County, Ohio. The Parkview Condominiums LLC has requested that said easement be released. After investigation, it has been determined that release of the subject easement will not adversely affect the City and therefore should be released. The following legislation authorizes the Director of the Department of Public Utilities to execute those instruments necessary to release the aforementioned easement.Fiscal Impact: The $500.00 to be received by the City of Columbus, Department of Public Utilities, as consideration for the subject easement will be deposited into the appropriate fund. Emergency Justification: Emergency action is requested, by the Division of Real Estate, to allow for the immediate release of the aforementioned easement, for which the required fee has already been received.

To authorize the Director of the Department of Public Utilities to execute those instruments necessary to release an easement, located in the vicinity of Goodale Boulevard and Poplar Avenue, at the request of the Parkview Condominiums LLC and to declare an emergency.

WHEREAS, The City of Columbus, Ohio, holds title to a certain easement, located in the vicinity of Goodale Boulevard and Poplar Avenue, by virtue of Miscellaneous Records Vol. 14, Page 621, Recorder's Office, Franklin County, Ohio; and
WHEREAS, The Parkview Condominiums LLC has requested that said easement be released; and
WHEREAS, the Division of Sewerage and Drainage has determined that the release of said easement will not adversely affect the City of Columbus; and
WHEREAS, the Real Estate Division, Department of Law, has determined the value of the release of easement to be $500.00; and
WHEREAS, an emergency exists in the usual daily operation of the City of Columbus, that it is immediately necessary to authorize the Director of Public Utilities to execute those instruments prepared by the Real Estate Division, Department of Law, necessary to release certain easement rights in and to certain City owned real property for the immediate preservation of the public health, peace, property and safety; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of the Department of Public Utilities be, and hereby is authorized to execute those documents, prepared by the Department of Law, Real Estate Division, necessary to release those easement rights acquire by virtue of Miscellaneous Records Vol. 14, Page 621, Recorder's Office, Franklin County, Ohio:
Section 2. That the City Auditor be and hereby is authorized and directed to deposit the Five Hundred Dollars ($500.00), to be received by the City as consideration for the subject release of easement to be granted, in the appropriate Department of Public Utilities fund or as follows:

Section 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
