Title: To authorize the Director of Public Utilities to establish a Purchase Order with Hickman Lawn Care, Inc., for Lawn Maintenance in Zones 1, 2, and 3 from the current citywide contract for the option to purchase such services, for the Division of Sewerage and Drainage; to authorize the expenditure of $157,000.00 from the Sewerage System Operating Fund; and to declare an emergency. Explanation
1.  BACKGROUND:
 
    A.   Need.  This legislation authorizes the Director of Public Utilities to establish a purchase order for Lawn Maintenance (mowing) in Zones 1, 2, and 3, from the current City Universal Term Contract (UTC) for these services, for the Division of Sewerage and Drainage.  Additional mowing sites acquired by the City under the capital improvements program result in a contract above the $100,000 limit in Section 329.07(g), CCC, thus requiring this legislation.
 
    B.   Contract Compliance No.:  311432478
 
    C.   Type of Business Enterprise:  Majority.
 
    D.   Emergency Designation:   Emergency designation is requested; however, this is only because of an extended bidding and award period for the UTC, which has prevented this legislation from being processed until now.  Mowing services are needed by approximately April 15, 2005.
 
2.   FISCAL IMPACT:
 
     A.   Budget Information:  The FY2005 Budget allocates a total of 199,050.00 for this purpose.
 
     B.   Historical Data:  Amounts appropriated to this purpose in recent years are as follows:

3.   PROJECT LOCATION:
 
     This project involves all of the Division's major facilities, City-wide.

To authorize the Director of Public Utilities to establish a Purchase Order with Hickman Lawn Care, Inc., for Lawn Maintenance in Zones 1, 2, and 3 from the current citywide contract for the option to purchase such services, for the Division of Sewerage and Drainage; to authorize the expenditure of $157,000.00 from the Sewerage System Operating Fund; and to declare an emergency. Body
    WHEREAS, the Division of Sewerage and Drainage requires Lawn Maintenance services for the proper operation and maintenance of its facilities; and
 
    WHEREAS, provision of Lawn Maintenance services by contract has been found to be the most cost-effective means of providing mowing for the Division; and
 
    WHEREAS, the City's Purchasing Office has recently bid these services for a City-wide option contract under Solicitation #SA001527, and such contract is being established via Ordinance No. 0571-2005; and
 
    WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Sewerage and Drainage, in that it is immediately necessary to authorize the Director of Public Utilities to execute a purchase order for Lawn Maintenance services for the Division, in order to provide proper operation and maintenance of the Division's facilities, for the preservation of the public health, peace, property, and safety; Now, Therefore,
 
    BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
    Section 1.   That the Director of Public Utiloities be, and hereby is, authorized to execute a purchase order with Hickman Lawn Care, Inc., 2809 Harrisburg Station Lane, Grove City  OH  43123, for Lawn Maintenance in Zones 1, 2, and 3, for the Division of
Sewerage and Drainage, in accordance with the terms and conditions of the newly-established citywide contract to purchase such services, pursuant to Solicitation #SA001527, and established under the authority of Ordinance No. 0571-2005.
 
    Section 2.  That the said firm shall perform the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Sewerage and Drainage.
 
     Section 3.  That the expenditure of $157,000.00, or as much thereof as may be needed, be and the same hereby is authorized from the Sewerage System Operating Fund, Fund 650, Department 60-05, to pay the cost of this contract, as follows:

    Section 4.   That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure which shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
