Explanation
The Transportation Division is engaged in a project that will upgrade the intersection of Agler Road and Cassady Avenue.  The proposed upgrades include installation of sidewalks, curb ramps and signal poles.  The City Attorney's Office has been acquiring additional right-of-way to accommodate the proposed upgrades.  Ordinance 1152-2005 passed by City Council July 25, 2005 established initial funding in the amount of $15,000.00 for acquisition-related activities.  The City Attorney's Real Estate Division staff recently notified the Transportation Division that an additional $3,500.00 will be required to complete acquisition of the right-of-way needed for this project.  This legislation authorizes the City Attorney to expend an additional $3,500.00, or so much thereof as may be necessary, to complete acquisition of fee simple title and lesser interests in and to property needed for this intersection improvement project.
 
Fiscal Impact:  Additional acquisition-related expenses are currently estimated to be $3,500.00 for this project.  Monies to pay for these costs are available in the Transportation Division's General Permanent Improvement Fund.  This ordinance appropriates these funds as necessary and authorizes their expenditure.
 
Emergency action is requested to allow acquisition-related activities to be completed without delay to allow construction of the proposed improvements to commence in 2006.

Body
WHEREAS, the Transportation Division is engaged in a project that will upgrade the intersection of Agler Road and Cassady Avenue; and
 
WHEREAS, the proposed upgrade include installation of sidewalks, curb ramps and signal poles; and
 
WHEREAS, the City Attorney's Office has been acquiring additional right-of-way to accommodate the proposed upgrades; and
 
WHEREAS, Ordinance 1152-2005, passed July 25, 2005, established initial funding in the amount of $15,000.00 for acquisition-related activities; and
 
WHEREAS, the City Attorney's Real Estate Division staff recently notified the Transportation Division that an additional $3,500.00 will be required to complete acquisition of the right-of-way needed for this project; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that it is immediately necessary to authorize the City Attorney to expend the additional funds necessary to complete acquisition-related activities for this intersection improvement project without delay so that construction of this project can proceed during the 2006 construction season, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the sum of $3,500.00 be and hereby is appropriated from the unappropriated balance of the General Permanent Improvement Fund, Fund 748, and from all monies estimated to come into said Fund from any and all sources and unappropriated for any other purpose during the fiscal year ending December 31, 2006, to the Transportation Division, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6601, OCA Code 748599 and Project 537650.
                                    
SECTION 2.       That the monies appropriated in Section 1 shall be paid upon order of the Public Service Director and/or the City Attorney and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.
 
SECTION 3.  That the City Attorney be and is hereby authorized to continue acquisition-related activities necessary to complete acquisition of fee simple title and lesser interests in and to those parcels needed for the Agler Road and Cassady Avenue Intersection Improvement project and to expend those funds required to pay related acquisition costs.
 
SECTION 4.  That for the purpose of paying for said costs the City Attorney's Office is hereby authorized to expend an additional $3,500.00, or so much thereof as may be necessary from Fund 748, the General Permanent Improvement Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6601, OCA Code 748599 and Project 537650.
 
SECTION 5.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
