Explanation
1.  NEED:
This legislation authorizes the Director of Public Utilities to enter into a professional engineering services contract with DLZ Ohio, Inc.  This contract will provide for the preparation of construction plans and specifications for the Olentangy-Scioto-Interceptor-Sewer (OSIS) Augmentation Relief Sewer, Whittier Street to the Jackson Pike Wastewater Treatment Plant.
 
Once constructed, this relief sewer will significantly reduce the City of Columbus's largest Combined Sewer Overflow (CSO).  The work will include the construction of a large diameter conduit approximately 15,000 lineal feet long, depending on the final alignment.  The project will begin at the Whittier Street Storm Tanks by connecting to the OSIS.  The sewer will then cross the Scioto River, on the upstream side of the Greenlawn Dam, and then turn south to the Jackson Pike Wastewater Treatment Plant.  The work will include provisions for the controlled storage and release of the combined sewer flows to pumping facilities and/or treatment facilities.  This project is necessary for the City of Columbus to become compliant with the terms set for in the Combined Sewer Overflow (CSO) Consent Order between the City of Columbus, Ohio and the State of Ohio.
 
2.  PROCUREMENT INFORMATION:
The basis for selection of the chosen professional engineering services firm: The Department of Public Utilities advertised a Request for Proposals (RFP's) for the subject project professional engineering services, in accordance with the provisions of Section 329.14 of Columbus City Codes.  Four firms submitted qualifications to the Director of Public Utilities on Friday, May 6, 2005 (SEE ATTACHED LEG. INFO).  An Evaluation Committee ranked all of the offerrors based upon the criteria specified within the advertised RFP.  
 
These proposals were reviewed and ranked by a Professional Engineering Services Selection Committee in order to determine the consultant best qualified to provide the services for this project.  The committee ranked the proposals on quality, feasibility and cost.  DLZ Ohio, Inc ., was selected to provide the engineering services for this project.
 
3.  PROJECT SCHEDULE:
The construction plans and specifications prepared under this contract will be completed in February, 2008.  The easement acquisition services are currently anticipated to be completed during the Fall of 2008, with construction award proposed for October of 2008.  Construction is estimated to require 16 months for construction, with a completion date April, 2010.
 
4.  FISCAL IMPACT:
This ordinance requests the appropriation of design loan proceeds from the Ohio Water Pollution Control Loan Fund in order to fund this proposed expenditure.  The Division anticipates seeking a construction loan through the same fund when the construction plans and specifications have been completed and necessary easements have been acquired.  
 
5.  EMERGENCY DESIGNATION:
The Division of Sewerage and Drainage is requesting City Council to designate this ordinance an emergency measure in order to allow for the immediate commencement of this work.  The completion of this project is necessary to comply with the terms contained within the City's Consent Order agreed to between the City of Columbus and the State of Ohio.

Body
WHEREAS, the Director of the Public Utilities received technical proposals from professional engineering service firms who were interested in providing services for the Olentangy-Scioto-Interceptor-Sewer (OSIS) Augmentation Relief Sewer, Whittier Street to the Jackson Pike Wastewater Treatment Plant, from the firms of Burgess & Niple, DLZ Ohio, MS Consultants and Malcolm-Pirnie, for the aforementioned project services; and received these proposals on May 6, 2005; in accordance with the procurement provisions of Section 329.14 of the Columbus City Codes; and
 
WHEREAS, based upon an evaluation of these proposals utilizing predetermined criteria, a selection committee determined that DLZ Ohio, Inc., submitted the best proposal for the required project services; and
 
WHEREAS, the Ohio Water Development Authority (OWDA) approved a design loan to the City of Columbus on January 26, 2006, in the principal amount of $5,622,070.00, identified as OWDA Loan Number XXXX, for the above listed project with eligible costs to include the entire professional engineering agreement referenced herein; and;
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, in that is has been determined necessary for this Council to authorize the Director of Public Utilities to award a professional engineering services contract for purposes of providing the aforementioned services; to authorize the appropriation and expenditure of funds from the Water Pollution Control Loan Fund; and to amend the 2005 Capital Improvements Budget, in order to proceed with the design services that are necessary to construct the infrastructure that will significantly reduce the City of Columbus's single, largest point of combined sewer overflow, pursuant to the preservation of the public, health, peace, and safety, now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the proceeds from the Ohio Water Development Authority Loan No. XXXX, for the Olentangy-Scioto Interceptor Sewer (OSIS) Augmentation Relief Sewer, Whittier St. to the Jackson Pike Wastewater Treatment Plant Project; and funds from the unappropriated monies in Fund No. 666, the amount of $5,622,070.00 for the cost of a professional engineering services contract, shall hereby be appropriated to the Division of Sewerage and Drainage as follows:

Section 2.  That the Director of Public Utilities be, and hereby is, authorized to enter into a professional engineering services contract with DLZ Ohio, Inc., 6121 Huntley Road, Columbus, Ohio 43229, in connection with the capital improvements projects identified within Section 3 herein, in accordance with the terms and conditions of the Contract on file in the office of the Division of Sewerage and Drainage's Sewer System Engineering Section.
 
Section 3.  That the expenditure of $5,622,070.00, or as much thereof as may be needed, be and the same hereby is authorized from the Ohio Water Pollution Control Loan Fund No. 666; Division 60-05; within the following projects:

Section 4.  That the 2005 Capital Improvements Budget Ordinance No. 1070-2005 is hereby amended as follows, in order to provide sufficient budget authority for the execution of a professional engineering service contract award as referenced in the preamble hereto:
