Explanation
Background:
- Bids were received by the Recreation and Parks Department on September 27, 2005, for the Alum Creek Trail: SR 161 Underpass Project, as follows:

- Project includes new asphalt trail along Alum Creek from Casto Park to Strawberry Farm Park, which includes clearing, new asphalt, concrete curbing, grading, fencing, seeding, landscaping, etc.
- The Contract Compliance Number for Columbus Asphalt is #31-0857095.
- A contingency amount of $20,000.00 is being included in this project.
- Emergency legislation is necessary so initial stages of work can begin in fall 2005 for spring 2006 asphalt work.
Fiscal Impact:
- $249,961.85 is required and budgeted in the Voted 1999/2004 Parks and Recreation Bond Fund to meet the financial obligation of this contract.

To authorize and direct the Director of Recreation and Parks to enter into contract with Columbus Asphalt for the Alum Creek Trail: SR 161 Underpass Project, to authorize the expenditure of $249,961.85 from the Voted 1999/2004 Parks and Recreation Bond Fund, and to declare an emergency. ($249,961.85)
Body
WHEREAS, bids were received by the Recreation and Parks Department on September 27, 2005, and the contract for the Alum Creek Trail: SR 161 Underpass Project will be awarded on the basis of the lowest and best responsive and responsible bidder; and
WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary enter into contract so initial stages of work need to begin in fall 2005 for spring 2006 asphalt work; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of Recreation and Parks be and he is hereby authorized and directed to enter into contract with Columbus Asphalt, for the Alum Creek Trail: SR 161 Underpass Project, in accordance with plans and specifications on file in the Recreation and Parks Department.
Section 2. That the expenditure of $249,961.85, or so much thereof as may be necessary, be and is hereby authorized from the Voted 1999/2004 Parks and Recreation Bond Fund No. 702, Dept. 51-01, Project 510316, Greenways CIP Bond, Object Level 3 - 6621, and OCA Code 644526.
Section 3. That for the purpose of paying for any contingencies which may occur during this project, the amount of $20,000.00 has been included in Section 2, above. This amount will be expended only after approval by the Director of the Recreation and Parks Department, certification by the City Auditor, and approval of the City Attorney.
Section 4. That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
Section 5. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
