Explanation
1. BACKGROUND
This ordinance authorizes the Director of Public Service to execute a modification for a professional engineering services contract with URS Corporation - Ohio for the Arterial Street Rehabilitation - Hard Road Phase A Sawmill Road - Smoky Row Road project. This is the second modification to the original contract.
The scope of work for the original contract focused on: widening Hard Road from two lanes to five lanes, turn lanes, new pavement, curb, sidewalk, street lighting, storm sewer, traffic signals, signs and pavement markings.
Modification 1 provided design services to update plans to incorporate additional comments received on roadway construction plan documents; perform a profile evaluation to balance lowering over water main, provide design and pre-construction services and provide post-construction record plan drawings with an electronic and hard copy submission.
Modification 2 will provide design services for plan evaluation and plan updates for green infrastructure to treat the water quality volume and detain the storm water runoff volume to levels required per the City of Columbus Storm Water Drainage Manual.
This modification will allow for the continuation of previously authorized work and additions to the scope of services.
Original contract amount: $1,201,162.00 (Ord. 1108-2010, EL010946)
Modification 1 amount: $105,000.00 (Ord. 2205-2012, EL014387)
Modification 2 amount: $79,169.65 (This Ordinance.)
The contract amount, including all modifications: $1,385,331.65.
Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against URS Corporation - Ohio.
2. CONTRACT COMPLIANCE
The contract compliance number for URS Corporation - Ohio is 341709349 and expires 3/21/15.
3. FISCAL IMPACT
Funds in the amount of $79,169.65 are available in the Storm Build America Bonds Fund, Fund 676 within the Department of Public Utilities. Amendment to the 2014 Capital Improvements Budget is necessary to establish sufficient cash and authority in the proper project.
4. EMERGENCY DESIGNATION
Emergency action is requested to allow for the Department of Public Service to make funding for the design of this project available and allow the project schedule to proceed as planned, thereby preserving the public health, peace, property, safety, and welfare.

WHEREAS, Ordinance 1108-2010, authorized the Director of Public Service to enter into contract with URS Corporation - Ohio for the Arterial Street Rehabilitation - Hard Road Phase A Sawmill Road - Smoky Row Road project in the amount of $1,201,162.00; and
WHEREAS, Ordinance 2205-2012, authorized the Director of Public Service to enter into a contract modification with URS Corporation - Ohio for the Arterial Street Rehabilitation - Hard Road Phase A Sawmill Road - Smoky Row Road project in the amount of $105,000.00; and
WHEREAS, additional engineering and design services are needed for the Arterial Street Rehabilitation - Hard Road Phase A Sawmill Road - Smoky Row Road project for the purpose of providing design services for plan evaluation and plan updates for green infrastructure to treat the water quality volume and detain the storm water runoff volume to levels required per the City of Columbus Storm Water Drainage Manual; and
WHEREAS, it is necessary to execute a contract modification to Contract No. EL010946 to authorize additional funds and expanded scope for the professional services required for the engineering and design of this project; and
WHEREAS, this ordinance authorizes the Director of Public Service to execute a professional services contract modification for the Arterial Street Rehabilitation - Hard Road Phase A Sawmill Road - Smoky Row Road project; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is necessary to provide additional funding for engineering design services to allow the schedule of this project to proceed as planned thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the 2014 Capital Improvement Budget authorized by Ordinance 0683-2014 be amended as follows to establish sufficient authority for this project:

SECTION 3. That the Director of Public Service is hereby authorized and directed to modify and increase an existing professional engineering services contract with URS Corporation - Ohio, 277 West Nationwide Boulevard, Columbus, OH 43215-2566, for the Arterial Street Rehabilitation - Hard Road Phase A Sawmill Road - Smoky Row Road project, in the amount of up to $79,169.65.
SECTION 4. That for the purpose of paying the cost of this contract the sum of up to $79,169.65 or so much as thereof may be needed, is hereby authorized to be expended from the Storm Build America Bonds Fund, Fund 676 as follows:

SECTION 5. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
SECTION 6. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 7. That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.
SECTION 8. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same
