APPLICANT: Central Ohio Transit Authority; c/o Brian Metz, Agent; TranSystems Corporation; 5747 Perimeter Drive, Suite 240; Dublin, OH 43017.
 
PROPOSED USE:  Parking lot for COTA Park & Ride.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (6-0) on August 14, 2008.
 
CLINTONVILLE AREA COMMISSION RECOMMENDATION:  Approval.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The requested CPD, Commercial Planned Development District will allow expansion of an existing COTA Park and Ride lot northward onto an undeveloped parcel.  The Park and Ride lot will be the only use permitted on this site, and the CPD text provides development standards for parking setbacks, site access, landscaping and fencing, and lighting and graphics controls.  The requested CPD, Commercial Planned Development District is consistent with the zoning and development patterns of the area.

WHEREAS, application #Z08-034 is on file with the Building Services Division of the Department of Development requesting rezoning of 0.68± acres from AR-1, Apartment Residential and CPD, Commercial Planned Development Districts to CPD, Commercial Planned Development District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the Clintonville Area Commission recommends approval of said zoning change; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the requested CPD, Commercial Planned Development District will allow expansion of an existing COTA Park and Ride lot northward onto an undeveloped parcel.  The Park and Ride lot will be the only use permitted on this site, and the CPD text provides development standards for parking setbacks, site access, landscaping and fencing, and lighting and graphics controls.  The requested CPD, Commercial Planned Development District is consistent with the zoning and development patterns of the area, now, therefore:

SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

1. INTRODUCTION: The northern portion of the property is currently zoned AR-1 and has been vacant wooded land since at least 1938. The property comprises approximately 0.179 acres and is currently grass-covered vacant land. COTA wants to expand the existing park and ride, located to the immediate south, into the property to attain additional parking spaces. The existing park and ride is located at 4939 North High Street, consists of approximately 0.5 acres, is currently zoned CPD, per zoning ordinance Z02-108, and is currently owned by the Central Ohio Transit Authority.
 
2. PERMITTTED USES: The only permitted use shall be the Central Ohio Transit Authority Park and Ride lot as shown on the site plan (includes a locking bike rack location).
 
3. DEVELOPMENT STANDARDS:
 
Unless otherwise indicated the applicable development standards are contained in Chapter 3356 C-4, Commercial of the Columbus City Code.
 
A. Density, Height, Lot and/or Setback commitments:
 
The parking setback from the current edge of pavement of High Street shall be 25 feet which is 15 feet from the right-of-way line of High Street.  The parking setback from the AR-1 parcel located to the north shall be 10 feet. The parking setback from Rathbone Avenue shall be 10 feet.
 
B. Access, Loading, Parking and/or Traffic related commitments:
 
There shall be no access to North High Street; access to the parking lot shall be from the existing curb cuts on Rathbone Avenue and the alley to the west.
 
C. Buffering, Landscaping, Open space and/or screening commitments:
 
1.     The east and south setback area shall contain a 3' high hedge to provide headlight screening and street (shade) trees per the overlay plan.
2.     The north setback area shall contain evergreen trees planted at a staggered 5' interval to provide 75% opacity and a visual barrier required in the overlay plan.
3.     Along the western property line, (alley) a 6' high wooden decorative fence will be constructed to provide screening for housing located within the Delawanda subdivision.
4.     All trees shall meet the following minimum size at the time of planting: Shade trees 2.5" caliper, Ornamental trees 1.5" caliper, Evergreen trees 5 feet in height.
5.     A three foot high mound shall be installed along the North High Street right of way and it shall have a slope of no greater than a 2.5:1 ratio.
6.     A three foot high mound shall be installed along the northern setback area and it shall have a slope no greater than a 1.5:1 ratio.
7.     Landscaping shall be maintained in a healthy condition and dead materials shall be replaced with new landscaping which meets the size requirements contained in the text within a reasonable time period, weather permitting.
8.     Existing trees located along the northern property boundary shall be preserved to the extent feasible.
 
D. Building design and/or Interior-Exterior treatments: N/A
 
E. Dumpsters, Lighting, Outdoor display areas and /or other environmental commitments:
 
1.     Lighting
a.     All external outdoor lighting shall be cut-off fixtures (down lighting) and shall be designed and placed to prevent spillage of light off the site and to prevent glare visible from the property lines and lighting shall not exceed .1 foot-candle along the property line of a residentially used or zoned property.
b.     All exterior lighting shall be from the same or a similar manufacturer's type and style to ensure aesthetic compatibility.
c.     All light poles and standards shall either be constructed of black, brown or bronze colored metal.
d.     The average horizontal illumination level on the ground shall not exceed two (2) footcandles.
e.     The height of any source of exterior area lighting shall not exceed eighteen (18) feet above grade.
 
F. Graphics and Signage commitments.
 
1.     The one (1) ground sign shall be a monument style sign with a maximum height of six (6) feet and it shall be setback from any right of way a distance of fifteen (15) feet.
2.     All other signage and graphics shall be as otherwise indicated in the City Graphics Code, Article 15, and Title 33 of the Columbus City Code as it applies to the C-4, Commercial District or as approved in a graphics plan.
 
G. Miscellaneous commitments
 
The development of the site will conform to Community Commercial Overlay standards except as requested below.
 
 
H. Variances Requested
 
1.  To vary the parking setback requirement (3372. 098 (D)) by reducing the required parking setback from 25 feet to 15 feet.
 
4. CPD REQUIREMENTS:
 
a. NATURAL ENVIRONMENT: The northern portion of the subject site is currently a vacant grass covered lot. This property has been undeveloped since at least 1938. The southern portion of the property is a COTA Park and Ride that has been present since approximately 2003.
 
b. EXISTING LAND USES: The northern portion of the property is currently zoned -AR1 Multi-Family and the southern portion is zoned CPD. The property located to the north is an apartment building zoned AR-1, to the south and to the west is residential, and to the east is North High Street followed by Commercial (C-4) with a variety of commercial development along High street
 
c. TRANSPORTATION AND CIRCULATION: There shall be no access to North High Street; access to the parking lot shall be from the existing curb cuts on Rathbone Avenue and the alley to the west.
 
d. VIEW AND VISIBILITY:  In the development of the subject property and in the location of the access points, consideration will be given to the visibility and safety of the motorist and pedestrian.
 
e. EMISSIONS: The emission of sound, odors and dust will have minimal effect on adjacent properties.
 
f. BEHAVIOR PATTERNS: This site would service those that wish to use the COTA bus system and would increase the level of service already experienced by users of the existing COTA Park and Ride located to the south.
 
SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
