Explanation
Background: This legislation authorizes a modification to the design contract with DLZ Ohio, Incorporated, (formerly Dodson-Stilson, Incorporated) for the Hilliard Rome Road project. This project is being designed to reconstruct and widen Hilliard Rome Road from Westchester Woods Boulevard to south of Roberts Road. Total project length is 1.19 miles. The construction includes the addition of three (3) new traffic lanes, sidewalks, tree lawns, bike lanes and utility relocation. It is estimated to have a project start date of June, 2010 and end June, 2012.
The contract modification is necessary to provide additional design services to update plans to incorporate additional comments received on Right-of-Way and roadway plans, design of one (1) additional signal, provide drainage plans not in the original scope, edit field survey and provide as-built plans.
This modification is an addition to the original scope of services but is a continuation of the existing work being performed and it would not be practical to contract with a different consultant.
Current hourly rate, the overhead rate and the percentage of profit that were negotiated at the beginning of this project were used to determine the amount of this modification. DLZ Ohio, Incorporated (formerly Dodson-Stilson, Incorporated), CC #311268980, expiration 4/16/09, was selected in 1998 in accordance with Chapter 329 for professional service contracts.
The original contract amount was $438,862.00. The amount of this modification is $54,840.00. The total of all modifications is $358,574.00. The contract amount, including all modifications is $797,436.00.
Emergency action is requested to complete the project design work as soon as possible in order to accommodate the construction commencing January 2, 2010 consistent with the State's schedule.
Fiscal Impact: Funds to pay 100% of these costs are budgeted and available in the 1995, 1999, 2004 Voted Streets and Highways Fund. These funds will be transferred to fund 765, the Federal State Highway Engineering Fund. This ordinance authorizes the expenditure of $54,840.00.

To authorize the Director of Public Service to modify and increase the contract with DLZ Ohio Incorporated (formerly Dodson-Stilson, Incorporated) for the preparation of construction plans for the Hilliard Rome Road project for the Transportation Division; to authorize the City Auditor to transfer $54,840.00 within and from the 1995, 1999, 2004 Voted Streets and Highways Fund to the Federal State Highway Engineering Fund; to appropriate $54,840.00 within the Federal State Highway Engineering Fund; to authorize the expenditure of $54,840.00 or so much thereof as may be needed from the Federal State Highway Engineering Fund; and to declare an emergency. WHEREAS, contract no. CT-19809 was authorized by ordinance no. 2327-98, passed October 16, 1998, executed and approved by the City Attorney on October 23, 1998; and
WHEREAS, it is necessary to modify this contract to increase the scope of services per the consultant's letter dated January 5, 2007 for the Hilliard-Rome Road project; and
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that the contract should be modified and increased immediately so that the work may proceed without delay, thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the transfer of $54,840.00 within Fund 704, the 1995, 1999, 2004 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, be and hereby is authorized as follows:

SECTION 3. That the sum of $54,840.00 be and hereby is appropriated from the unappropriated balance of Fund 765, the Federal State Highway Engineering Fund, and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ending December 31, 2007, to Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6682.
SECTION 4. That the monies appropriated in the foregoing Section 4 shall be paid upon order of the Public Service Director and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.
SECTION 5. That the Director of Public Service be and is hereby authorized to modify and increase contract no. CT-19809, with DLZ Ohio Incorporated (formerly Dodson-Stilson, Incorporated) in order to complete the design, construction plans, and permits for the Hilliard-Rome Road project in accordance with the plans on file in the office of the City Engineer.
SECTION 6. That for the purpose of paying the cost of the contract, the sum of $54,840.00 or so much thereof as may be needed, is hereby authorized to be expended from Fund 765, the Federal State Highway Engineering Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6682, OCA Code 561005 and Project 561005.
SECTION 7. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 8. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
